Brought a second hand moped

Hi I brought a second hand moped for my child, it broke down only after 2 days , it went to for repair twice after this.


it now has completely broken down, we have taken it to another trader to look at, and they have given us a breakdown on what's wrong. It basically needs a whole new engine.


I have contacted the CAB, but not 100% what to do now.


Would anyone here know? Thanks

    Did you buy this from a private individual or a business?

    If it was a private sale, pretty much the only protection you have is if they intentionally mis-described the thing.

    If you bought from a trader, your protection is far greater.

    What did CAB say?

    Hi it was brought from a trader, the response was what my rights are now, but OH said he thinks it different as its second hand not new. we spent £650 on it and £150 on second trader looking and diagnose it.


    My child has gone 100 miles on it. We had one month warranty with it brought end of july
  • What bike is it? How old is the bike? How many miles and what did it cost?

    £650 to buy it? £150 to diagnose it? What did he do for that money?

    Rather steep unless he stripped it down.

    Is it a 2 stroke or 4 stroke?

  • 2011 bike, brought for 650 from first trader, another bike place striped it I have the receipt and list if problems.

    Your rights are exactly the same beit new or secondhand.

    MSE's Consumer Rights guide explains it quite well:
    Second-hand or 'on sale' doesn't mean second-rate

    Even if the item's second-hand or reduced, it doesn't mean you get second-rate consumer rights, except where the seller pointed out the specific problems before you bought.

    The same consumer rights rules apply to second-hand and sale goods from shops. They must be of satisfactory quality and, if they're faulty, you can return them.

    If you buy a used motor from a trader or grab a £700 'sale' telly with 30% off and it goes kaput once you get home, then take it back and complain.

    It's worth stressing that the second-hand price will be taken into account. So if you buy a car for a fiver, you wouldn't expect it to run normally.

    If you BOUGHT it using your card you may havr some redress from the bank.
