Driveway Problems council/housing association... please help!!!

  • Hi, we've spoken to ealing council, the person who deals with these issues is very difficult to get hold off as everytime we call it goes on voicemail and none of the other council employees are helping. We also spoke to the highway department and that did not help the case they just said speak with your council. It's like we're going in circles phoning the same places over and over again.

    We even sent a cheque of £30 for admin fees for them to process the application as we thought there wouldn't be a problem with it but as it is now the council has taken the money and refused the permission for crossover.

    We also get ticket officers on this road now so not sure how they operate if Ealing Council hasn't taken over the area.

    Can the estate put the double yellow lines if the road is not controlled by the council or can the council put the double yellow lines if they don't even control it?

    Also there was a fire truck that was having trouble getting through one of the roads and after that they put the double yellow lines, the truck didn't even get stuck in our road.

    If the road is unadopted then the council cannot legally enforce any parking restrictions, if they do then then can get into serious trouble.
    It being unadopted it can be subject to Private Parking companies dishing out fake parking tickets which can easily be thrown out etc, double yellow lines on any private property mean nothing basically as they are not subject to any statutory rules or regulations.

    have the written to you saying your application has been reused or have they just replied saying that the road has not yet been adopted so they cant grant permission

    one of my neighbors had to wait over a year because his property front was on a one way street and they said that the only way they would grant permission to cross was if he could drive in and turn the car within to confines of his property so he could drive out ie, not reversing into or out of a one way street
  • Hi, well since the surgery opened, i am not sure who allocated them the parking which was meant to be for the people who live in the flats (who moved a lot before) and outside the surgery they have this board which shows a company called OPC who control that area and might have private ticket officers for that area but since the area around my house is not controlled by them, we still see ticket officers who are working for ealing council.

    Quoting the refusal letter:

    "Unfortunately we have found that your property is located on a road which is not maintained by the london borough of ealing" - Estates and Development Engineer

    The housing association say they can't do anything and Ealing council says it's not maintained by them so how do i find out who it's maintained by?

    looking at google earth all of your neighbours on the opposite side of the street have been provided with off street parking, all your neighbours back down the road from you have parking bays which are parallel to the road

    the only houses that haven't been provided with parking are the three up near the junction which includes your house, this would suggest to me that planning restrictions didnt allow them to provide parking

    if this is the case then you will never get approval to drop the kerbs and permission to cross probably due to the proximity to the junction with taywood road

    Looking at google earth the fact that your road has road signs with Ealing and Northolt on them suggests to me that the road is adopted and is the responsibility of ealing, also the fact that there is double yellow lines and they are enforced by Ealing civil enforcement officers also suggests that the road is the responsibility of Ealing council
  • Any Idea on what we should do then? as you said it may be not possible to get the kerb drop? apart from leaving this house and moving on.

    sorry i dont know what you should do now, i wouldnt give up just yet and i would keep contacting the council and asking them if the road is not adopted then who is responsible for it

    what you need is for somebody to say sorry you cant have a licence to drop the kerbs because you are to close to the junction which would make reversing in or out dangerous, or yes it may be approved take it to planning, you need to know one way or the other

    I have just completed a notice of close to say my project is now complete and all works are now finished

    looking at the problems that you are having I was very lucky and it all went very smoothly and without hitch
