Driveway Problems council/housing association... please help!!!

Hi all,

We moved into a newly built area in 2007 and mortgaged in 2011 and our house is at the junction of the 2 roads. We don't technically have any parking space located in front of our house so we just use to park it on junction and wherever we could park it. Problems started arising when they opened up a surgery near our house and this caused all the patients to start parking in areas where we use to park causing even more problems. But the real problem is the Double Yellow Lines that have been put on the roads now, in front of our house and near it. We weren't told about the problems that we will be facing with the double yellow lines which were put here this year!

We now want to build a driveway so we can park the cars easily. The council is saying 'We don't own the roads yet, we haven't taken over this area yet' so we can't give you permission for a driveway. The housing Association say the same thing so we are stuck in limbo. No one is helping us. Now the estate manager says since our house was built on junction of the roads, you may not be allowed to build a driveway.

What can we do? Really need some help with this issue. Will provide more information if needed.

    If you really are on a junction, particularly a busy one, you may well find you are not allowed a driveway, as the exit would be considered a hazard.

    The Highway Code forbids parking on a road within 10 metres of a junction, or opposite, or something like that. If the junction has become busier, and there are more people parking there, that's why the yellow lines have been added.

    Without knowing exactly what the layout is, it's difficult to be more precise.

  • Is there a way i can attach some pics? it's not really a busy road. and speed limit is around 10-20mph

    so parking on the junction was an issue and it is now being enforced by double yellow lines

    as for the council saying they don't own the roads yet, is the development of the estate still work in progress?

    if it is still work in progress then the council may not have adopted the roads yet, when the development is finished the council will inspect the roads and pavements and if the meet the required standard then the council will adopt the roads and then they are responsible for them

    I would say the the problem you are having is with the application to drop the kerbs and crossing the pavement, if the council have not adopted the road then they cant issue a licence to drop the kerbs, the other thing that may go against you is the fact the you will be entering and exiting the road at or close to the corner

    also a quick question what type of drive have you put in and have you done any work on the pavements or kerbs yet
  • As far as we know everything seems to have been completed as we don't see any construction vehicles or builders near our home or area, there wasn't a problem with parking for around 3-4 years until the surgery and the double yellow lines.

    We haven't done anything yet as we don't want to get into trouble with the council for starting work without permission. Just to add we're 100% buyers of the property. No Lease nothing.

    is your house the one with the silver vw outside or do you live further up near to the junction?

    also who have you spoken to re dropping the kerbs and putting in a drive
  • Hi, it's in the 2nd pic, number 35.

    And we tried talking to council and they said since we don't own the road yet we can't give you permission to get kerbs dropped

    who have you spoken to at the council, was it the highways department?

    the fact that the road has white lines yellow lines and the like suggests to me that the roads have been adopted by the council, they may have adopted the road but not the pavements

    I would try and find a contact at your local highways and street works department and try and speak to them, from looking at the photos you posted and looking at google earth, i assume that the drive would go to the right of the front door as you look at the house from the road then you may be a bit close to the junction to have a drop kerb

    I see that the developers have put parking bays in from number 31 back but thy have held it back from the junction

    try and find the contact at highways and see if you can get a highways inspector out to look at it for you

    From the layout of the properties, the size of the gardens, and the road, I would be very, very surprised if permission were given to use the garden as a drive. I may be wrong, but I'd probably bet a substantial amount on your not getting permission.
