Help & advice needed for pip decision

Please can anyone help us?

My hubby has had DLA at the highest mobility rate and middle care rate for the last 10 years. He got the PIP renewal pack through in January and had his f2f approx 8 weeks ago.

He has just had the decision through and been told he doesn't qualify for any kind of daily living and only the lowest mobility rate which means his car will now have to go back. Tried ringing them because the reasons given are ludicrous! But i got told they could do nothing until the decision maker rings on the 20th (do they ring on a Saturday?) and I can explain it to them.

They've scored him zero for so many things that do apply to him. Just about the only things he doesn't need help with is communicating. They claim because he uses crutches to struggle walking 10 mtrs it means he can walk over 20 metres and also because he uses an electric scooter! There are just so many more things they seem to grossly underscored him for. He is incontinent so he can manage his toilet needs! Because he can't use the shower (its upstairs and we are waiting for a downstairs washroom to be fitted - 2 yrs so far!) he doesn't get any points for that. All the nurse kept saying who saw him at the f2f was "so really then its your surroundings that stop you" - erm no its the fact he can't do xyz!!!!!!:mad::mad::mad::mad::mad:

Please, please can someone advise us or help us? He's now saying he'd be better off dead and he's praying for a heart attack to happen to kill him (also has a bad heart!) - but he doesn't have depression though!:(:(:(:(:(

    You need to get some professional help from welfare rights about this. He also needs to get medical evidence about his needs too.

    Not going to answer all of this.

    As a general point, in order to do a thing, you have to be able to do it ' safely, to an acceptable standard, repeatedly and within a reasonable time period.'

    If he can't shower because he can't walk upstairs to the shower - that _DOES_NOT_ count.
    If he 'needs assistance to be able to wash his hair or body between the waist and feet' (in order to do it in no more than twice the time a normal person might take, safely, ... then he would attract points.

  • His GP sent in evidence backing up his claim! The f2f guy said they decision maker doesn't include this as they only say what we tell them!!

    He asked my hubby if he felt he had depression and he answered no so he accepted that. Isn't that the usual response from people with depression?
    Especially as he tried to take an overdose once before - he told everyone it was an accident so no one did anything further!

    He said you've put you get anxiety - any evidence of that? Erm like what exactly? Right well I've have to put no to that.

    Just wish I could talk to them now, my head is all over the flipping place.

    Does the decision maker ring people on a Saturday? Just seems odd to me when they don't even open on a Saturday
  • Incidentally he got 6 points for the daily living and 10 for the mobility.

    Hi, You need to send in more evidence Consultants, occupational therapists letters etc. and ask for a mandatory reconsideration. Also sadly even though your husband can't manage the shower because it's upstairs like someone pointed out. This doesn't count when scoring for daily living with PIP. Shower/bathing needs only count if you can't manage washing your upper or/and lower body. PIP is completely different to DLA it's how the condition affects you NOT about the condition itself. Send in extra evidence as i'm sure that will help.     The Benefits and Work website has a full guide on how to appeal every section of the report. Not sure if you need to buy membership to access it but they usually have 20% offer off the fee. Best wishes and good luck as it must be very upsetting.

    I wouldn't pay to get advice. You can get equally good free advice from CAB, etc.

    CAB etc are unfortunately - especially following the drastic reduction of funding due to legal aid rule changes - extremely overworked - and wait times may be extremely long.
