Garden fences/walls can be erected to butt up against the invisible boundary line by either neighbour..................

just sitting here wondering whats the point in having deeds of convent about whos fence is who's as there's no legal obligation to repair/replace :-/it is definitly his fence.
if i could afford to replace it i would (even though i don't think i should have to)

Its his children that will come into my garden too, not just my dogs entering his garden
he is a builder by trade (although not been working for the last at least 2 years) so i know he is more than capeable of repairing/replacing himself. Its just frustrating that he hasn't (if it was a money thing for him, then i think that the 2 take aways they have delivered every week could surely cover the cost if they were to go without them)
Unbelievable, you not only want to dictate about the fence, but also tell him what he can spend his money on and what he is allowed to eat. FGS
i don't mind what kind of fence it is as long as it keeps the children out and dogs in.
So repair it yourself, as it sounds like your neighbour is under no obligation to maintain a dog proof fence - it's YOUR dog!0 -
This 1 has really raised a few eyebrows, not exactly polarising opinion but near,
The law is clear, the OP has been advised of that, but getting a poor or lethargic neighbour to put up a boundary "barricade" simply isn't covered by law, they don't have to.
Several posters have said in not so many words, coerce them into it, ie, gentle persuasion. So whats that?
Well from that point of view you have no positives, you can't act. but unfortunately your neighbour can.
Expect to find all the dog crap collected and dutifully returned to it's rightful owner.

Many years ago I went to stay with a friend in his caravan in "skeggy". He was havinf problems with his neighboring owner/dog
We came back late 1 sat eve after a liberal lubrication.
He stepped into an almighty pile of ex Alsatian.
All the doings shovelled up on the kids spade, he marched next door, knocked on the caravan door and calmly said, "you've left something behind, I've brought your sheit back" and threw it into the caravan

I haven't refused to accept, i understand thats the law (after being told in a not so polite way by some) just don't agree that its fair, but if we all agreed it would be a very boring world.
You want a dog proof fence. then you provide it.
You seem to think that it is unfair that you are being told, that fencing your dogs in is your responsibility, and not that of your neighbour.
The facts of the matter are not going to change just because you seem to think that they are unfair.
Even if the neighbour did replace the fence he is under no obligation to do it to the standard that you seem to think that he should.I can afford anything that I want.
Just so long as I don't want much.0
