Neighbour not replacing fence

Options
i have no idea if this is in the right place or not, appologies if not, but i am just after some advice

My neighbours fence which divides our garden is on its last legs and every little gust of wind i fear will blow it down.
I have approached him several times as i have two dogs and he has young children, so i wouldn't be able to let the dogs out if it does go. 2 years ago it was damaged in the winds and it took him well over a year to repair it which was a nightmare as i had to take the dogs out in the garden on leads otherwise they would go straight into their garden. each time i ask he says he will but never does. is there anything i can do?
I have receintly replaced the other fence in my garden so cannot afford to replace his fence too.

Many thanks..

If you have dogs, it is really up to you to make sure that your garden is secure, not your neighbour.

there is nothing you can do. If your neighbour decides that he doesn't want to repair it then he does not have to. You are responsible for keeping your dogs in your own garden.

In that case it will almost certainly be your responsibility to prevent your dogs straying outside your garden.

Do you know if there is any deed of covenant that requires your neighbour to maintain a dog proof fence... or any fence?

Occasdionally within the deeds of a house there is a covenant to maintain a fence. Hoeever, this is very rare.

If you want your garden to be secure for your dogs, then it is up to you to endure th boundaries are secure.

I'm sure your neighbour wont object if you repaired his fence.

Are you sure it's his fence.
Maybe if you offered to go halves with him.

  • Just to add, if a covenant did exist, unless it stipulated the type and/or height etc, it could be just be a wire, strung between posts.

That's all there was between our gardens on a new built estate 25 years ago.

Each neighbour on each side wanted a solid fence and us to pay half to keep their kids from straying, we didn't have any kids so we were not bothering.

I put a berberis hedge up on my side of the wire fence, that kept their kids from straying.

They ended up putting their own fences up and I removed the hedge.
