    Well I would reply as per zzzLazyDaisy's robust response example in the LBCCC fightback thread already linked for you. The response needs to come from the registered keeper NOT saying who was driving.

    However he could add (to Daisy's example template) that he was not driving on that occasion and so UKCPS would have needed to comply with Schedule 4 of the POFA 2012 in order to pursue this charge against him. As it is in the public domain that UKCPS were not using compliant Notice to Driver and Notice to Keeper letters at the end of 2012 then there is no cause of action against the keeper and any continued contact is harassment. This letter is a warning to cease and desist this harassment of a registered keeper who cannot be held liable, and this latest desperate trawling through old cases to try to extort money from keepers when the 'second condition' for keeper liability, as defined in the Schedule, has not been met, smacks of desperation by UKCPS. Any further correspondence except to cancel the PCN will be forwarded to the BPA and DVLA as evidence for a formal complaint for serious breach of the BPA Code of Practice regarding misleading correspondence with motorists. An Operator, or their agent, cannot pursue a registered keeper where the requirements of Schedule 4 were not met, and that would include any UKCPS ticket issued in 2012 and 2013 (and arguably, 2014).

  • Amended again I think !!

    There was no ticket I put it turns out the car was parked wrong as we got the letter on Saturday and that was the first we knew

    I can't amend when people have quoted can I ???

    -then, can you punctuate 2nd sentence please? Is it this?

    Does this mean this new letter, received last Sat., describes the alleged parking event?
    Does it refer to any p/w nos. suggesting that an NTK was issued but unseen by you at the time?

    To cllarity the first we knew was Saturday but I remember the date and why

    What gives a ticket number? The Notice to Keeper (NTK) that UKPCS sent 2 years ago, have you still got that (the first letter)? Please show the NTK, both sides, if you have it.
