We Have No Consumer Rights - Laptops Direct.

Good day folks, it turns out that if you trust any loss adjuster to purchase goods on your behalf with any retailer the contract of sale is with the loss adjuster and the retailer, we the consumers gets the goods but we are not covered by the sale of goods act 1979 because we never purchased the item directly!

Laptops Direct sent my gf a LENOVO Y510P that had manufacture design faults we contacted Lenovo within two days, they were brilliant and issued LEDOA RMA number we then got in touch with Laptops Direct who stated that they would replace as soon as they get the laptop into their care.

Two weeks on they don't disagree its a design fault but before they issue a replacement they sent it to their distributors (not Lenovo) for a refund yesterday they were forced to tell us they had no contract with us at all as they only answer to the loss adjusters!

To complicate matters further Laptops Direct claims the two day old laptop came back to them in terrible condition and littered with food in the inside of the box and covered in chocolate which is total rubbish it went back in better condition than my gf received it in as the box seal was already broken!

Anyone also been told this rubbish by this retailer just so they have a back up plan to send the unit back so they are not out of pocket?

Any one reading this and going through this or in the future take pictures or a video of your repacking exercise before sending back to them.

Laptops Direct have promised to contact us repeatedly and its always us that have had to do the calling which is nothing new as the web has other documented cases of this poor customer relations from this retailer. (We now know she was never the customer).

Is this true we have to wait until someone else has to refund Laptops Direct even though Lenovo has confirmed they are aware of some issues and our unit was one of those that slipped through their quality controls or should the loss adjusters take a stronger line against their suppliers?

    Surely you should be dealing with the insurance company who have supplied the laptop to you? By going directly to their supplier (Laptop Direct) you will be bound by the terms they set.
  • You will have no consumer rights because you are not a consumer.

    If your insurers have supplied a defective item then its your insurers that the complaint should be directed at.

    Secondly, if you did deal with things yourself and got an RMA number from the manufacturer why send it back to the retailer rather than the manufacturer? You are just adding extra legs in the journey.

    The supplied unit was less than two days old so is classed as a DOA which Laptops Direct SHOULD ACCORDING TO THEIR TERMS AND CONDITIONS replaced straight away.

    OP. You have no contract with Laptop direct. Your contrct is with your loss adjuster only. You need to deal with your problem through them.

    Once more. you have no contract with them. so their T&Cs only apply to the insurer
  • Got a feeling this one is going to the wall, hope the crash helmets are well fitted
  • Your all spot on the fight is with the loss adjuster and they are not happy they have been found out the moral of this story is for all claims to be paid in cash only so claimants can evoke proper consumer law on their parts.

    It's been a good learning curve and hopefully this will help other claimants decide a better path than us.

    But a cash settlement can be reduced to reflect the discount that an insurer receives from their preferred suppliers meaning you need to add more to it to get the same item.

    I think the real moral of the story is to learn who your contract is with and at the point of needing to enforce your rights then go to the company who's in contract with you.

    Your contract is with your insurers, its not even the loss adjuster that you have a contract with. Its against your insurers that you can escalate your complaint to the Ombudsman which is free for you but circa 500 quid for them win or lose and so makes economic sense for them to want to resolve the matter for you.

    Why risk court rather than using the ombudsman that is always free for you and always costs your insurer circa 500 quid? :huh:
