  • ive emailed them to that effect Dee , but they say they want admin fee plus half my outstanding balance...im not sure where i stand.

    In effect the PPC has done what its supposed to and rabidly pursued people....its Xercise4less thats at fault with all this by not communicating and protecting members.

    You could try telling them that their actions in failing to notify members of the details of the parking scheme were misleading and that their actions (through their agent VCS) in pursuing and continuing to pursue substantial charges arising are aggressive.

    Misleading or aggressive practices are offences under the Unfair Trading Regulations 2008, therefore you intend to report the matter to Trading Standards.

    Furthermore, come October 1st you will have the power under the Consumer Protection (Amendment) Regulations 2014 to sue both the gym and VCS in respect of misleading and/or aggressive actions, should they be foolish enough to continue pursuing you after that date.

    Alternatively they can get VCS to cancel the charges and they can themselves release you from your contract without charge, and you will consider the matter closed.
