I hope another thread is appropriate as i dont want to dilute my Appeal thread...when i get around to it.
I just want an opinion from those in the know.
I wont go through the whole story...as i have in my previous thread.
Just i have 5 PCN's from VCS from using my own Gym carpark (Xercise4less) and lack of appropriate communication to the procedure to avoid getting a PCN.
Anyway myself and a few members have been kicking up a fuss - Press are involved, ive been blocked by xercise4less twitter account ( bet im easy to spot haha).
After email after email from customer support saying nothing they can do. I have recieved an email this morning saying due to complaints about treament from VCS - Xercise4less have now removed the parking system from the wigan site and as soon as they have any information regarding outstanding charges they will contact me.
My question is - if the the company who engages VCS to look after the carpark then kicks them out because of their behavour , does that not make it harder for VCS to justify in court those PCN's already issued?
I wont be holding my breath and will...be sorting my appeal. im just wondering how they have a leg to stand on?

I would say that it makes it impossible for the PPC to proceed, not only from a business point of view, but in court, were they daft enough to go there.
This company seems to be very much on the up, and the last thing they need is a PPC upsetting their clients. I am glad to see that they recognise which side their bread is buttered..You never know how far you can go until you go too far.0 -
Its taken a lot of pressure from their members , i just wish they had done some homework on how VCS treats people.0

Another point is that the gym has enganed this company to act for them and on their behalf in ( so called) the managing of their car park.
This means that anything the parking company does, as agent the gym can be held responsible for as the principle, even after the principle ( the gym) has booted the agents (vcs) out.
So unless the gym takes action and tells the ppc to cancel any invoices then you can hold the gym responsible for any costs/problems or issues that you experience as a result of the parking company actions.
If you are going to do this then you need to let the gym know. From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
ill have to wait for the Gym to respond. But its definatley an interesting development0

"We engaged with an expert in the field in a contract that gave them the authority to manage the car park on our behalf."
<shakes head in disbelief>
An expert in the field of gouging the innocent and unwary maybe.Je suis Charlie.0 -

I would be very tempted to be waving those parking tickets at the gym, telling the they and breached your contract with them and you are withdrawing with immediate effect.
