Fee for POPLA

Hi
We have used advise on here and have asked that POPLA mediate instead if the small claims track service and have been sent form N244 . I phoned for explanation and they say we need to fill this in and send fee for £150 to use POPLA

Can anyone advise?

    Who is they ? Who sent the form and who did you ring ?

    POPLA is free to the driver / registered keeper. All the private parking company need to do is give you a POPLA code - they can't charge you for it.

    I think the OP has court papers and wants the court to order it to be referred to PoPLA. The court is saying she needs to complete the application form and pay the £150 application fee.

    Sally, has the case been allocated to your local court or is it still with Northampton?

  • Sorry, Birmingham County Court...we waited till we had the letter with the judges name as advised and wrote to him asking that POPLA mediate instead of the small claims track service ...now they have sent this form and want £150 with the Application Notice filled in......

    This is the standard court fee to get a judge to make a decision. He may decide not to use popla, in which case your 150 would be wasted.

    Surprised that you hadn't read and gleaned from other threads that this is always a possibility (in fact quite likely with some courts). Asking for POPLA doesn't necessarily just 'get POPLA' if your court would rather just charge £150 for a preliminary hearing. I would not cough up any money and like liseylou and 45mip19lot (whose hearings are soon-ish but not at Birmingham) plough onwards to be ready for your hearing.

    You could have a final throw of the dice before the hearing gets set, by writing back to the court saying no thanks you didn't want to pay £150 for an application for any preliminary hearing. But if the Judge is not minded to consider an order for POPLA as the bespoke parking industry ADR, instead of a hearing, then could the court instead consider a stay for the PE v Beavis Court of Appeal outcome instead...(obviously citing the dates and case number at the CoA).*

    Unless you already did ask for that as well. In which case that's something to ask for again towards the end of the hearing if you feel it is being railroaded towards the Judge believing PE v Beavis is persuasive. You can ask for a stay on the day as well which is what liseylou and 45mip19lot may have to try as a last gasp attempt if their hearings don't go well.

    It's around £190. Have a look at the latest updates on liseylou's thread tonight though. Two cases PE didn't win today, at Portsmouth Court!
