Parking Eye court claim advice

I am posting my own thread as I was advised to do when reading the advice offered previously.

I have received the usual letters from Parking Eye stating that I have breached their parking rules and not being the driver I chose to ignore them.

The next thing is I received a letter from the County Court in Northampton, and being hot headed, I replied stating I was not the driver and would fight it if they continued. Now I realise that I should have consulted this site first.

What should I do now?

Once I read this forum, I wrote to PE, using one of the template letters here, that basically said I wanted a breakdown as to how they arrived at the costs, who owns the site etc..etc.

Now I have received a letter once again from the court saying that the claimant wants to pursue the matter, but if I agree, I can use the free mediation service provided by the court and still go on to a hearing if I am not satisfied with the outcome.

I believe I should at least agree to a mediator because it shows the court that I am willing to co-operate, but I do not intend to pay the £100.

What options are open to me now?.....PE did not reply to my letter, as you said they wouldn't.

    You are going to get a CCJ if you do not wake up very quickly indeed.
    Start by downloading the parking pranksters court guide, you can find it on Amazon.

    Oh dear - you currently have NO DEFENCE SUBMITTED AT ALL. Sort it out quickly with transcripts & exhibits and a proper defence written, see the Parking Pranksters Guide. If you ask where to find it then the reply is...read the small claims links in the NEWBIEs sticky!

    And act quickly - you are about to lose in court like a typical PE victim, for the sake of some reading & climbing a steep learning curve. You could always make an offer at Mediation I suppose but a robust defence from someone who grabs victory from the jaws of defeat, is far better! You cannot just rock up at court with unsubmitted evidence though so you will see the procedures from the forums you have, to submit your defence & evidence you intend to rely on. For the love of God, forget the outdated rubbish about who was driving, and read the recent winning cases v PE and print out the transcripts as evidence and use them in your defence wording about 'no loss', 'no standing', etc.

    Also is your court in Essex, Suffolk, Norfolk or Cambs?

    Thanks for replying.
    I have downloaded Parking Prankster and will read it thoroughly....but what about the facts that they have not offered me a POPLA Code?
    Not given me a breakdown of costs? Not followed the rules laid down according to Prankster and this forum?
    Can I say all this in court when I get all my evidence together? Or is it too late?

    The court they applied to is Northampton, but I believe it will be held locally to me, which is Hampshire as I live near Portsmouth.

    Also, should I accept the services of a mediator? Because I will accept nothing less than them accepting payment for just the extra time with is around £1.80...but really I want them to cancel the charge altogether.

    Thanks Coupon-mad......I should have read the stickies first, but I think we all just want someone to put things right instantly and I see that cannot happen.....

    One post has answered my previous question regarding whether to use Mediation, so I am OK there. I will read up as much as I can and try to make some sort of defence for myself......

    I am pre-empting the sticky, but I am not sure when/how I should submit my defence to the allocated court?.

    Well have you completed the N180 yet? The link to bargepole's summary of 'what happens when' is the best thing I can refer you to, it's one of the links I give in the NEWBIES thread post #5 about small claims.

    You must submit your defence to be received by PE and the court, not later than 14 days before the hearing date. Get reading of the Prankster's Guide and printing off transcripts of wins, which will make up some evidence for your pack.

    Benefit Master is fairly local to you but I am not sure if he has the capacity to help you at this late stage where your defence has so far missed the point. See here where he's helping a local who has a claim from another PPC:

    I am just about to send off the N180.....I am going to request mediation, but only intend offering the cost outstanding (£1.80 or so).
    They will not go for that, so it will go to court now.

    I have posted on Pepipoo as well, and Bargepole has offered some advice.

    Just before I submit my final defence, would you be in a position to take a quick look at it if I PM you?......I don't want to inconvenience you in any way.

    Hang on, "certain defeat", that's a bit alarmist.

    The last few cases where PE took someone to court the appellant did not get to say a word, the judge was so busy lambasting PE about their lack of standing, redacted contracts, late submission of evidence, and unprepared solicitors, it's almost as if they were conducting a vendetta against PE, and this is even before Maloney HHJ has had his wicked way with them.
    You never know how far you can go until you go too far.

    Update:

    Just received an N271 from Northampton county Court stating that this claim has be transferred to Portsmouth County Court and to await the Judge's directions.
    I phoned Portsmouth, but the clerk there was unable to help me as she was not legal trained.
    Do I send my updated defense now? or wait to hear from the court in Portsmouth?
    I know the letter says await the Judge's directions, but I am just a tad concerned that a decision will be made using my initial defense and not any subsequent submission.
