    I post as SRM on pepipoo, do your utmost to drag this to a winnable POPLA case instead. That poster is not the only one who got it agreed, you too may be lucky if you strike while the iron is hot.

  • Hi Coupon-mad.....Thanks, I will do as you suggest straight away.

    Just to let you know, I wrote back to PE again stating that they had not replied to my original letter (as expected) and in this letter I also said that I was surprised that they had refused to go to mediation, even though it was not binding, as they stated in their letters to me that ' We do not want to waste the courts' time'
    Then I received a letter from them in the same post as the letter from the Northampton court. In this letter, PE half heartedly responded to some of my questions from my original letter AND said that they had now decided to accept mediation.
    I phoned the Northampton court and they said as far as they were concerned, it has been passed on to Portsmouth and they have missed the boat as far as mediation is concerned. What a bunch of amateurs !!......more evidence for me to show the court if it does go that far.

    But court is a last extreme resort. It will save your nerves and effort and time if you follow coupon and get the code

    OK.......sorry for all the inactivity.

    I now have a date for the hearing at Portsmouth CC......It is set for 2nd September.
    I have until the 31st July to submit my defence.
    I believe I have a reasonably good witness statement, having used the vast wealth of knowledge provided by Parking Prankster, but I would like to get some critical feedback from anyone willing to comment.
    The problem is, the document is over 20 pages long and growing....anyone know how to post it as an attachment? How are these documents normally posted? as I have only come across POPLA statements on this forum.

    First things first - write to ask for POPLA instead and/or a stay of the claim and the hearing to be vacated, pending the Parking Eye v Beavis court of Appeal decision (the latter only if you WANT your case stayed and reliant upon another case). You've missed quite a lot while you were not on the forum! See the NEWBIES thread post #5 for the letter to use, and see the links here:

    If you don't want to grab onto the coat-tails of Mr Beavis and his appeal then at least ask the court for POPLA (which you would win!). See the NEWBIES thread post #5.

    Coupon-mad..........look at my post number 16 (25/4/14).

    I hand delivered a copy of your letter requesting a stay, ref: The Cambridge appeal and nothing was heard again from the court.

    Do I have to do it every time there is a possibility of a stay and then hope that on one occasion they agree to it?

    It worked for me - case stayed for 1 year, to be dismissed at that point unless applied for re-opening before then by either party.

    I suggest following CM's advice.
