Is there any law about driving on private land without barriers? Do they still have the right to fine you? Because on the car park you can freely drive on and off..where most car parks we use you have to go
in via barrier and take a ticket. With this car park you can freely drive on and off even though the signage says there is a fee....how can they enforce if you can freely drive on and off? Clearly no loss of earnings on their part0 -
They don't have any right to "fine" anyone to begin with.
Court actions usually hinge on contractual issues or costs involved.0 -
Please tell us what stage you are at, as you are still thinking of this as a 'penalty charge' with 'laws' which it isn't, it's contract law. And you don't appear to be focussed on the right defence points if you are asking the above, so we want to help you. Did you read liseylou's thread and have you revisited post #5 of the NEWBIES thread? That post shows you all the links I could collate to show someone how to win at court like liseylou did, or at least to get the case stayed for the ParkingEye v Beavis outcome (if you aren't familiar with the Beavis case you do need to take a step back and read more on here).Hi

Have you got a court date yet and the date to file your final defence and exhibits? Which court please as sometimes 'we' are local enough...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
