Jeez how did this simple thread get so relatively long? It doesn't take much searching this forum for the keyword 'UKCPS' to learn that they throw in the towel when they see the template appeal from the newbies thread! What's all the worry about - this OP won't even need POPLA. This from a thread where I have collated a few examples of easy wins by newbies at the first appeal stage:

Hi again. This is getting a bit complex for my little brain now...
Firstly we heard back from the hospital Estates manager who agreed to waive the charge. Unfortunately when my wife gave his the ticket number it turned out to not be one of their car parks.
It seems that there is a private car park sandwiched between two council/hospital car parks. See here.

We then waited to hear from the garage if they had received a NTK which they did but was complicated as the garage had leased the loan car so the NTK went to the lease company. The lease company had written to the garage saying "we have made representation to the parking operator advising them that the vehicle is in your possession" ie the garage.
The garage then sent this to me as we had agreed to sort it out and would like to keep our relationship with the garage.
The other thing is that the NTK was dated the 2nd October and the day that my wife had parked in the car park was 1st September which is greater than the 29 to 56 day limit which is mentioned in your newbie thread.
Does this give us more ammunition?In most cases, only send an appeal or challenge when the PPC send you the postal 'Notice to Keeper' (NTK) or 'reminder to keeper' or Parking Charge' or 'charge notice' or whatever they call their first letter. If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to) the Notice has to arrive by day 15 if there was no windscreen ticket, and between day 29 and day 56 if there was a windscreen ticket. Some firms (e.g. Civil Enforcement, Smart Parking and some small PPCs) don't even bother with POFA2012 so the keeper is not liable - obviously the keeper is the only person identified in your appeal then!
So I'm a little unsure as to what to do next? Use the appeal template on the grounds that the NTK was late? Try to build a case on the grounds that there is little signage that indicates that this car park sandwiched in the middle is private? There is another website dealing with a similar issue.

I've not been able to ascertain who the landowner is as per your flowchart as it seems to be an old pub which had a gas explosion in 2008.

Your arithmetic is a bit awry. 1st October is certainly between 29 and 56 days after 1st September.
Just send the template. You are not the registered keeper, but you don't need to be, you were the actual keeper at the time. Have it say that you are the person to whom the courtesy car was loaned and therefore you were the keeper at the time, you don't have to say who was driving.Je suis Charlie.0 -
