Well done re the MP, another one educated!
Why don't you send the CEO a copy of that letter of 7th July 2014 referring to an agreement dated 1st January 2014, and ask him why these were not produced in the response to your FOI?Je suis Charlie.0 -
I am Baz, but I am gonna wait and see what they send me today as per his letter yesterday. If I don't receive everything I'm expecting then that letter will also end up at the ICO as Proof of how obstructive they have been and failing to comply with the FOI Act.0

Also had a reply from the hospital CEO:
He is going to be extremely disappointed as I don't consider the matter closed in the slightest. It will also be interesting to see what they send me tomorrow. I'm expecting the novations and the GPEOL.
Especially when you tell him your MP agrees with you.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -

Outstanding from the Hospital:1/ Where in the contract does it state that APCOA is allowed to make parking charges for breaches?
The contract does not cover parking charged for breaches, see question 3 below.
2/. Query on the legal company name
I am sorry but in our haste to respond we have provided incorrect information, for which we apologise. We used the term
novation when this should have been name change. The transition from FMG (Harrow) Ltd to APCOA FM (Harrow) Ltd is solely by name change; please see attached certificates of incorporation and name change. The contract provided is therefore the correct
and sole documentation related to the current operation.
3/ Query on the legal right of APCOA to issue penalty charges without the lawful authority of the land owner
It is wholly appropriate for London North West Healthcare NHS Trust to empower the parent company and for it to receive the keeper details from the DVLA on the Trust’s behalf. APCOA are empowered to deliver the Trust’s Car Parking Policy (please see attached). This has been updated from the version included in the original contract in line with operational changes over time.
Further to your complaint, which included your request for the pre-estimate of loss upon which the parking notice fee is based and this is compiled as follows:- Loss of P&D revenue Tariff £12.20
- Cost of PCN issuance: Labour Cost / Licences / Software upload / Consumables / Misc. £12.25
- Associated Labour cost of officer patrol per hour: £9.05
- DVLA Fees / Processing Costs for appeals £15.00
- Admin Expenses for appeal: Stationery £3.00
- Postage £2.00
- Printing £2.00
- Attendant and POPLA Appeals staff wages and salaries including Employers National InsuranceAttendants (PCN recording and issuing) for a standard case £15.38
- Appeals Staff 1 hour (call handling / appeals writing) for a case £9.13
- Management at 3 hours (quality control / evidence gathering / appeal writing ) for a case £30.28
Taking this pre-estimate information the Trust has elected to offer a parking notice fee of £60.00 that will be discounted by 50% if paid within fourteen days. While the above costs exceed the parking notice fee both the Trust and APCOA has agreed the fee sum.
I trust that this satisfies your request and thank you for your interest in London North West Healthcare NHS Trust.
They have sent me the name change document, but it still refers to APCOA Facilities Management (Harrow) Limited, company number: 3481526 and not APCOA (UK) Limited, company number: 02572947.
So they still haven't provide proof of contract with APCOA (UK) Ltd, and certainly no mention of the agreements/letters that APCOA have provided to the DVLA. Another email to the ICO, me thinks.
I won't comment on the GPEOL, other than :rotfl::rotfl::rotfl::rotfl::rotfl:0 -
They are included day-to-day staff wages as part of the "losses". Those wages would have to be paid even if no one broke their rules. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
-
Sorry typo, I meant I won't comment, rather than I want comment.0
-
Geez they're taking you for a fool aren't they? A change from one company name to another but it's still the wrong bloody company.
Keep at it, my friend, keep at it!Je suis Charlie.0 -
Makes me think that the replies are being drafted by APCOA, and the trust don't understand the situation.0
