    if you really are going to be meeting this MP, I would ask him to check the Jeremy Hunt 2014 statement (give him the date too) and also ask him if he attended the debate in the house of commons and remind him of that date too, where Daniel Poulter as well as others debated these issues at great length

    if he did not attend, tell him it would help your meeting if he were to read the transcript of the commons debate BEFORE your meeting , if necessary consulting the other MP,s who debated it, especially if they are in his own party , as well as the Jeremy Hunt statement as well

    perhaps he can also check the details on the rights of disabled people, including any that do not qualify for a BB as well as for those that do (Equality Act 2010 , preceded by the DDA)

    ignorance is not bliss , especially not in this case

    Cheers Red. Yes, I am meeting my MP on the 18th. I was going to write a sort of an agenda with things I want to discuss with him forward it to him about a week before, so he can research and have some answers. Do you have anymore details on the above?

    TBF, I was out walking the dog in the freezing cold, trying to type on my phone when I replied.

    I have already mentioned about the DoH guidelines to my MP, but in his infinite wisdom, he deemed they didn't apply as the ticket was issued before the guidelines...

    Over a week later, I am still waiting on answer to a simply yes or no question, no whether it was the correct contract that the hospital sent? Anybody else get the feeling the are busy trying to dig their way out of this?

    Also, still waiting on their GPEOL. You would have that this would be an easy document to lay their hands on, as surely it is the cornerstone of their business?

    That should be very easy to answer - after all, the clue is in the title ... Genuine PRE-Estimate of Loss. So surely this was all calculated before anyone received a PCN, eh? ;)

    I emailed the acting CEO that exact thing last week, saying I expected the document they same day. Not even an acknowledgment, never mind a reply. Think they have me on their ignore list now.

    So it's been fairly quiet for a few days, but wasn't at work this afternoon, so have sent a hastening emails to DVLA:
    Thank you for your reply. However, I think it is totally unacceptable. As you are more than away, the BPA are a paid for members club, who’s only interest is their members. You are accountable for the information you release and not the BPA.

    Can you please update me with how your investigation is progressing? Also, can you confirm that you have suspended APCOA from accessing DVLA data for this site, until you confirm that all the appropriate authorisation is in place and therefore not breaching the DPA?

    I have reported the DVLA to ICO for breaching the DPA in light of this situation.

    The BPA:

    The hospital:
    I am struggling to comprehend why it is taking you so long to answer a yes or no question reference the contract? The longer it is taking you to answer it, the more I think you have something to hide.

    I am also struggling to understand what is taking you so long to locate your Genuine Pre-estimate of loss document. The clue is in the title, PRE-ESTIMATE, ie before the event. So therefore, you must have this document to hand?

    Can you please confirm when you will be in a position to supply this information?

    And am also in touch with the ICO about both DVLA and the hospital.

    They ought to know the answer. After all their reply to your FOI request was answered on question 7 in this way.

    7. APCOA provide all general management, monitoring, security and administration of the car parks. At NPSM the contract also includes for the funding and construction of the multi-storey car park; the land is held by APCOA under a formal lease. The contract is monitored via monthly meetings between the Facilities Team and APCOA.

    Had a reply from the hospital:
    Thank you for your email. I'm sorry you haven't had a response yet. I have checked one aspect of this in relation to the contract and can provide the following information confirmed by Simon Howorth, Deputy Senior Information Risk Officer for the Trust.

    The contract document which has been copied to you is the current contract. Its duration is 40 years, and the change of "owner" is by novation. Both the provider and the Trust have changed since inception. I do not have information about the genuine pre-estimate of loss, and will leave that to Gary Munn to confirm.

    Wasn't sure what "novation" meant so had to google it. Wiki says: replacing a party to an agreement with a new party. Surely that should be documented somewhere though, as an amendment to the contract something?

    Anybody with a bit more knowledge know how these things work?
