Finally got a letter from TCO indicating that they are actually on the way to rectify their mistakes!!! :j Not out of the woods yet tho as they said that their payment system is still not able to issue payments directly into my bank account. But as long as i get what i am entitled to they can issue it by dancing hippo for all I care :rotfl:

    Harassment pays people! oh...and the threat of a solicitor via a rather extensive letter to the second tier complaints department (I took no prisoners in that one)

    Hopefully my next post will be "ITS SORTED!!!" but i guess time will tell.

  • I recently got another demand for repayment of an alleged "overpayment" from years ago. My situation was sort of similar: HMRC claimed not to have received forms I sent them, and instead of using the information they already had about the number of children I have (1 in my case) they decided that my son had ceased to exist and stopped my payments without warning. I finally got my tax credits reinstated after months of hassle, but then got letters telling me I'd been overpaid because their system reasoned I was entitled to nothing for the previous year either. I explained the situation but was told I had to pay because it was my fault for not returning the form! After sending a letter to their complaints address I heard no more for a while and more or less forgot about it until I got another demand for repayment.
    I now use Recorded Delivery for correspondence with the IR so they can't blame me for failing to send paperwork which they've lost.
  • I had demands for overpayment for years dou to the errors of the TCO. Contact your MP and they might be able to sort this out for you.

    Also resubmit your complaint. They have a habit of not notifying you so keep resubmitting until they acknowledge that they have received it and they should give you a date for their response/findings. If you dont hear from them before the date they state then send another complaint. If you still don't get a satisfactory response you can go over their heads to the Adjudicators Office.

    Oh my word. I too thought I was bad off. I first tried to claim when it all began, I had 4 children then but it said I wasn`t entitled. I worked part time and earned well under the limit. Because of all the hassle that people were getting I left it. Then 2 years later I tried again only to be told my children were already subject to tax credit! mmmm finally they sorted it out and I received almost 10,000 in back payment. I didn`t dare spend it because of all the stories of overpayment that I had read. When I got the next years tax credit award and they didn`t ask for it back I then took the children on a nice holiday and also started spending that years tax credit.
  • Quite right to Space!! Their quick off the mark to tell you ur not entitled....then hope ya dont query it.

    Its good to see they occasionally admit they got it wrong :rotfl:

    Got a letter this morning agreeing that I do not have to pay back the few quid off £6000.00 they insisted I owed since April 2004!

    Fantastic news! I am still awaiting a decision re my alleged overpayment (the third occurance for me-they agreed their mistake the first twice!) from 2006/07. Nice to know that SOME people 'win'!
    Tomorrow is always fresh, with no mistakes in it!

    OMG just found this thread, I too went through hell at the same time (wasn't a MSE forum member back then).

    I was told i had lied to them, then i was told their system screwed up, then i was told it was the new system that replaced the old buggy system,

    Council tax well that was fun during that period, i rang them to say having financial hardship, they deny i made that call, lucky saved my phone bill which listed the council tax number, spoke to the same lady that called me a liar, and said are you still calling me a liar, she said she never did.

    they wanted to take me to court, they harassed me had bailiffs at my door, got my mp involved, not much of a success, ct dragged me through hell and back and wouldn't talk to tax credits. The whole thing made me depressed and suicidal, i was given those giro's and that was a nightmare as i had to cash them in and then go to the bank, and carrying around a thousand pounds in your bag is quite unerving they actually when they pulled their finger out paid me the correct money but oh yes a nightmare.

    the council tax thing just died away, no apologies nothing, but they wipped the court costs because i said there was no need for it to go that far when i had communicated all along and could prove i did. (they claim i never spoke to them) but now everytime i do call them i ask them to record the phone call so mistakes cannot be made.
    Life is about give and take, if you can't give why should you take?

    Congratulations on the overpayment. Have you got your current payments sorted out yet?

    we to can join the nightmare....we had been waiting 12 weeks so far for our wtc/ctc, phoned yesterday to say will still be at least another 3 weeks before they even deal with it,they keep droning on that it will be backdated,( that statement going to feed my kids this week) yet the only letters i get is saying i owe them money when they havent even paid us anything yet,
    we had to resort to taking a loan out so we dont lose our home,i so wish we were in the position to tell them to shove it where the sun dont shine....
    3 years is beyond taking the mick....
    its that messed up its beyond the help of the Jeremy Kyle show :)
