    You don't HAVE to give them any notice. There's no real laws around protecting lodgers, it's your house and what you say goes.

    Have you got any friends you can ask to come round to give you some back up.

    Failing that, call the police and advise them of their suspected activities.

    Basics

    1. You are living in the same house as these people?
    2. You have not given them a signed tenancy agreement (some people who have lodgers make this mistake)?

    Assuming the above in England and Wales, you need to give "reasonable notice" to a lodger. In this sort of case, an hour to pack their bags is reasonable.

    The stuff about 2 month's notice applies to tenants who have exclusive possession (generally can occupy the whole house or and agreed portion).

    Contact Shelter and they can clarify the situation.

    Note, based on previous threads it is extremely important that you contact the police in person and speak to someone reasonably high up the decision making tree. We have seen multiple tenants evicted illegally with police support and several landlords incorrectly told that they need to give notice to aggressive or abusive lodgers.

    If your lodger leaves the house and you're still inside, maybe you could just fix a bolt to the inside of the doors. Then have the locks changed before you leave the house...?
  • at the foot of the contract it says thre following two inmportant notices.

    1.This form of agreement is for use in those cases where the room is part of a house or flat which the owner occupies as his/her only principal home so that an aquired tenancy is not created.
    2.this form of agreement does not require either party to give any form of nootice to the other at the end of the fixed period, but if either party wishes to end this agreement early, then written notice should be served for the period as as stated in the early termination clause.
    does this cover me, even though the early termination clause is blank on the signed contract which ended on the 25/4/14

    It's your home.

    They are lodgers not tenants

    They are breaking the law.

    Tell the police.

    Throw them out.

    (now - call a friend/relative for back up and get on with it).

    The replies so far are fine. The written agreement you have means nothing in fact I wouldn't even bother with one they aren't worth anything at all and could actually give the lodger more rights than they otherwise would have had had there been no written agreement. It's very much a verbal contract you the lodger pay the rent weekly you stay a week you don't pay the rent or I don't accept the rent for any reason whatsoever the following week then you the lodger leaves the next day. That's it...no more.

    thank for being blunt, but without evidence i cannot accuse them of dealing, so i willl phone the police tomorrow to ask then to attend while the eviction takes place as i believe there is a high chance of threatening behavour, if they are not able to attend i will have to see who i can get as witnesses to the eviction so once threatening behavour has occurred the police ill become involved, thanks.
