just realised that in this case an LBCC was not sent prior to court claim form
now sent off skeleton defence off and directions questionnaire, can this be included as a defence point later on with full witness statement?

due in court Monday 30th
just getting as fully prepared as possible
SIP have sent no evidence whatsoever to defendant, we have submitted all relevant evidence to court as well as SIP (got proof of posting). can we challenge evidence submitted on day (if they do produce it) as not following protocol, and having no time to consider this prior to hearing.

Evidence must be furnished at least 14 (?) days prior to the hearing, I believe.
Make sure your copy of the evidence is wrapped in string/cord/ribbon and is only opened in front of the judge. DO NOT accept any paperwork from the other party outside the court room. Make sure you make the judge aware that you have not received any paperwork from the claimant that they are relying on in court.
Sounds to me like SIP are doing a runner and are withdrawing the claim. Might be worth a call to the court to see if the case is still scheduled.

yes case still scheduled, called court, but they said "file was in 5th Jan", which they could not explain what this was,evidence or not, as it was another town who deal with this courts enquiries.

unbelievable that they can get away with pulling out 10 mins before hearing starting, complete waster of time, will look at this case

Just back from court hearing
waited nearly 1 hour to go into court
was called in, no evidence of anyone else there
Judge informed us that he had received our evidence within timeframe and that SIP have not filed any defence, nor bothered to turn up in court today.
consequently he was striking out the claim
ask for costs, loss of earnings and preparing defence, would only award loss of earnings 2x £20 per hour = £40
unbelievable that they can waste not only our time, but more importantly courts time
anyway it appears that whilst they monitor forums, as coupon mad says, once they see a strong defence they do not bother to turn up.
