Otherwise, she would not be entitled to Legal Aid under new regulations. Not a mark or scratch was found on her by the Police. Shes declined to give a formal written statement to the Police as well..
Their marriage has only lasted for a year together.
If she gets Legal Aid she will exhaust every possible angle through the Solicitors to lengthen the process of getting a Divorce to get Indefinite Leave to Remain in the country. The 999 call had recordings of my friend repeatedly shouting for urgent Police help..
The system is shambolic.. She should be answerable to making false allegations..
Domestic abuse doesn't have to be physical.0 -
I think there has to be a reasonable amount of proof of domestic abuse although not necessarily violence before legal aid will be granted. One form of abuse is to threaten a person with a visa with deportation so the ops friend needs to ensure he hasn't done anything that could be construed as that. Abuse is not all about bruises.:jMay 2013 new beginnings:j0

Quite likely not even a real issue at all.0 -
Police often jump to the wrong conclusions.
A man in Bristol was harassed by neighbours for years, and complained to police, but they did nothing to protect him. When they did eventually come, they arrested the complainant for breach of the police, and later released him without charge back to the area, where he was eventually murdered.
Someone I know was arrested and charged with attempted murder of a police officer, they claimed he tried to push him off the edge of a tube platform. Case dropped when CCTV footage emerged showing no such thing.0 -

Always two sides to every story.0 -
Were you there or are you relying on the story told to you by your friend?
If it is the second of these then it was probably modified from the truth a bit.
Let the police do their job - they were there.35, semi retired, sun, sand, sea, life is good

Did you complain to the police?Shayboy786 wrote: »Sadly, IPCC does not consider this as a serious matter. So, any correspondence / complaint sent to them in relation to this would be directed / forwarded to the local Police station.
How convenient..
In most DV situations they will ask the male to leave or the calm person. If the person made an allegation of assault then the police have to arrest you in order to investigate it.0 -
Shayboy786 wrote: »Friend got arrested at his home at night few weeks ago.. After calling the Police for help twice in a space of 15 mins..
Reason for the call.. Was to control /evict the psychotic wife in the house. After an hour of rowing with her..she became unpredictable and started to use words such as assault..
He realised she is trying to get him done for Domestic abuse as the marriage is not working n since she had a Spouse Visa, due to expire soon. If my mate divorces her then she would have to go back to her native cave she crawled from..
Unfortunately, the common thug of an Officer responded with 5/6 others. After 20mins of talks and unnecessary negotiations.. My friend asked the Officer in charge for his name and collar number..
This irritated him to the point that he decided to arrest him instantly for common assault ( on the wife /alleged ).
Then he came back in the house and took away the piece of paper from the house with his details that were jotted down..
The shameless Officer lied on the arrest sheet as well !
On advice from the Duty Solicitor, matter was reported to the local Police Station. The Duty Inspector in charge was supposed to call back..since no details of the Officer in question.. We are finding it difficult to take this thug to task.
My friend was interviewed the following day in relation to the charges of Common Assault, released with No Further Action.
It's very frustrating to see the Officer behave in such a manner and he knows he can hide behind the system like a verminous rat..
Any suggestions and advice will be greatly appreciated.
Nice, classy, terms of reference there. Given that an hour of rowing (according to you) had already taken place, your "friend" had not been the soul of rationality and calm himself. How delighted the neighbours must have been to have had this resounding in their ears for ages...
I assume this post has not come from Scotland, where term has (thankfully) re-started?0 -

Well, there is if one side won't admit the truth.
In the Bijan Ebrahimi case the police admitted failing him.
