VCS Parking 'Fine' on Private Land

    Bit more digging and there are numerous documents in relation to this. They can be seen on publicaccessapplications.newcastle.gov.uk the reference is 2013/0145/MATCOU. All the jargon hurts my head but from what I can gather it has gone to the Home Secretary for review? It seems the property/land owners round about have made representations about this car park being here and from what I can gather they should not be still running as a car park until a decision is made?

    I'm just wondering if there is any mileage in including this in my soft appeal or just sitting on it for when I appeal to POPLA?

    It can't hurt, but it won't be considered IMO, think they would just go for the pre-estimate of loss on the appeal

    Update from Newcastle Council is that this plot of land cannot lawfully be used as a carpark and the enforcement IS still in place!

    It might be worth sending him an email prankster@parking-prankster.com he likes this sort of thing!

    This certainly opens up a can of worms.
    When they do send you a notice to keeper, it will be the cause of immediate complaint to the DVLA for requesting your details when they have no just cause to since they have not been allowed to run a car park there. You will request DVLA investigate this and as C-M pointed out in another thread, as the DVLA is a public body, all emails and replies can be subject to a FOI request.

    Also at that point complaints to ICO and Trading Standards for fraud as well as the local council.

    This is very much a case of roll on NTK!

    It is one to keep a close eye on, and it's to the credit of Newcastle council who is up on this, other authorities don't give a toss on planning applications that is required on private car parks.

    My reasons for trying to identify the land owner was to appeal to them to dismiss my PCN.
    I now have the details of the landowner, my question is, in light of my recent findings do I contact them and try to get my PCN wrote off or do I wait for the NTK?
    What I have uncovered does sound really interesting but ultimately all I want at this stage is for my PCN to be written off.
    What are people's thoughts?

    Make complaints by all means, but don't expect anything from the landowner, I've shared this off forum to people who have interest in this, one person mentioned that the landowner looks more dodgy than the parking company.

    I would wait for the NtK to arrive then appeal. I would go to trading standards on this as well, ensure you link through the planning refusal and the unlawful actions on there by these vermin.
