Won ebay auction - seller refusing to post goods.

Okay...basically I won an auction for a pair of shoes - cost just under £15 in the end.

Right after the auction ends I get a message from ebay saying the seller wants to cancel. The reason given is that the seller is selling the shoes on behalf of a friend, and the friend wanted to get at least £30 for the shoes. As they didn't sell for this much she wanted to cancel the listing.

I politely replied and pointed out that if the owner had wanted to sell the shoes for a minimum price then a reserve should have been put on the listing. As this had not happened I declined the cancellation.

Just now I got a message from the seller stating the following:

"
Please do not pay for your item as you will not receive it. I have explained the reason for why they are no longer for sale and if you choose to ignore it then that's your choice.

Regards

XXXX"

I realise that the odds of me now receiving the shoes are pretty much zero, but on the other hand I feel this is very underhand practice (seller currently has 100% feedback, so wasn't anticipating it) and I don't want to let them get away with it.

What is the best way for me to proceed with regards to making Ebay aware of what this seller is doing (and of getting my money back).

    Assuming you paid via PayPal just open an eBay case for item not received and get your money back that way.

    Once you have your refund you will be able to,leave appropriate feedback.

    You should be able to open an INR case once the delivery date has passed.

    Why did you pay for this?

    You refused the cancellation request, and the seller asked you to not pay. They can't raise an unpaid item case.

    I can't see the point in paying for it, and then raising a 'Not received' case to get your money back - just ask the seller to refund you?

    Paying with the intention of raising an 'item not received' case strikes me as abuse of the buyer protection program personally.

    As opposed to everything the seller did being within moral and legal constraints? Entered a contract to sell, buyer bought and paid and has a right to expect delivery of goods. Or perhaps doesn't pay and ends up with a non-paying strike?

    Sellers in the wrong ....he needs a defect.
    Hopefully he will not sell goods not in his possession next time or start at a higher price.


    its not even a justifiable excuse lol

    Haven't read the thread yet but I'm sure you'll have had good advice on how to proceed. You won't get item but should be able to leave informative neg. feedback.

    As a buyer, I'm really sick of idiots like this, who seem to be proliferating in ebay.

    I've had a few who have done things like this, making up excuses when item won for start price, listing items with clear defects but not mentioning them or actually purposefully hiding them, sellers who don't get more than minimum price, don't send, don't communicate or reply - and then keep on selling forevermore despite loads of negs! :mad:

    I "paid" automatically when I won the auction. Seller asked to cancel the auction as they didn't receive the minimum amount they had been looking for. As there was no mention of this in any way/shape/form in the auction (e.g. min selling price) I declined the cancellation as I was irritated at the seller trying it on.

    If ebay want to query me raising the non-delivery I now have a message from the seller stating that they have no intention of delivering. No offer of a refund was made, they just stated that they had no intention of sending the item and it was my fault?!

    I have no intention of letting them get away with this attitude, hence why I was asking for advice on the best way to proceed.

    How apologetic / polite were they initially? If it was a genuine mistake I'd just let it go. If the first contact was as rude as the later messages however it's probably worth warning other buyers via appropriate feedback.
