    The simple fact is that buyers get really cheesed off when searching for new items - then up pops a stream of second hand stuff.
    Either something is new, or it's used, there is no in between.

    But when describing the condition or wear of something if it is in the same condition in which it was purchased then it is 'like-new'

    Many of my books are 'like-new' in that i have read them but you would be un-able to differentiate between my copy and a new one, yet I cant advertise as 'new' as i have used it !

    I do not think it is as black and white as new or used, surely you want to describe your good as accurately as possible, and nearly new, like new, as new all describe more about the item than used.
  • I think ebay are being a bit silly about this: surely almost all buyers looking for new items will tick the appropriate box in the item specifics menu rather than search for the word "new"? After all, there's a common clothing brand called New Look which would also show up in searches for the word "new".
    Ebay and the snitchers who report rival sellers do seem to be having a clampdown on this though, so it's best to avoid using phrases like "as new", "like new", and probably even "nearly new" in titles, though I expect it would be tolerated in the description. Suitable alternatives might include "excellent condition", "worn once" or "pristine", for example.

    You are free to put 'as new' in your item listing, just not in the title.

    It's faster to report a guy with a handful of listings than it is to report someone with 100. Sad but true. (Only when I'm seriously perturbed by someone's listings will I report 100) Oh, and it's not me reporting 'as new'!

    Best thing is to lurk in forums like this, and ebay Q&A, to find out what the hot reportable offences are lately. (Right now, it's 'as new', as you found out!

    Was probably a miserable competitor who reported you!

    Better yet, removed 'as new', then not have to worry about being reported.
