chargeback refused cos i scrapped car?

    Presumably the claim has been declined because having scrapped the car you cannot prove the repairs were substandard as you didnt commission an independent engineers report into it or such before scrapping

    So you didn't give the repairing garage an opportunity to rectify the work?

  • Then make a Consumer Credit Act Section 75 claim against the credit card provider and if you still arent happy with the response then make a complaint and if STILL not happy then take it to the FOS for a ruling.

    The fact you havent had an independent engineers report into the matter is a bit of an issue and makes the complaint more complicated. The credit card company would only be liable for your losses and the fact you have scrapped the vehicle can be factored in.

    So using totally made up numbers - repairs cost £500, car repaired worth £750, scrapping the car you got £450. In that case £300 (£750-£450) would be an adequate settlement as it covers your shortfall given you've disposed of the vehicle.
