  • We have paid nothing up front and his fee is £400 but he never said whether it is payable if he can't place us. Will ask this too when he calls

    I have spoken to him and he really doesn't seem to have a clue. I think I have done more research than him to be honest. When I mentioned it he said but it's gone from his credit file and they've accepted you! To which I replied "yes but when their solicitors do a bankruptcy search it will only show 5 years 2 months discharged not 6 as it will be showing for up to 10 years!". He is now contacting his own solicitor to see if she can do a bankruptcy search (at a charge) to see if it will show up when Aldermore do their search at a later date. If she can and the fee is not too high then at least will we know whether to even attempt to go for this mortgage. Thank god for this forum!!

    The bankruptcy WILL show on a solicitors search.


    Your broker is a clown if he thinks he can get round this.


    Time to hold hands up, admit mistake and go begging to the lender to see if an exception is possible. If not and it will all collapse then they need to make provision to cover your fees incurred.

    IIRC a bankruptcy search is about £2 per person.

    As yet we have paid no fees as we are supposed to be putting the mortgage through tomorrow but don't want to get stung with surveyors fees if there's no chance of it going through. Can we put a bankruptcy search through ourselves Kingstreet or does it have to be a solicitor? Beginning to wish we hadn't even bothered with this "recommended" broker now. He hasn't got a clue :(

    Aldermore will do a soft footprint.
    One of the questions will be have you been bankrupt - to which the answer will be yes.

    If it passes the check at that stage, your laughing. If it does not then it will not have cost you anything. As its only a soft footprint the only people to see it will be you and aldermore.

    He says they have accepted us subject to survey so the ball is in our court as to whether we go for it or not but just a bit concerned that my partner is not 6 years discharged yet only 5. Also we do not have a certificate of satisfaction. At least I can't find it. Will we need to apply for one of these to the courts if we go ahead with the mortgage?

    It is possible the offer could be issued and withdrawn when the bankruptcy search by the solicitor is reported back to the lender.


    If the bankruptcy wasn't showing on the credit search then the lender wouldn't have picked it up.


    If it as disclosed on the application then the underwriters will pick it up and question the dates.


    If it wasn't disclosed then it hasn't been found and will be an issue when reported back from the solicitor.


    Have you had a copy of the application form from the broker to see if they disclosed it?


    The solicitor BR search isn't the same as the lender search hence why the full details need to be given to avoid problems and lost fees further down the line.

    I shall ask him if the bankruptcy has been disclosed. He is very aware of my partners bankruptcy so I hope he has disclosed it. At least we haven't gone ahead with the application yet and we won't be if it is deemed likely to be unsuccessful. Is it definitely a soft search that Aldermore perform? Nationwide states First Mortgage yet Aldermore states Mortgage Quotation on Experian.

    Its a soft footprint definitely.

    Send your broker an email, ask them if the bankruptcy was declared on the application. This way you have it in writing if it goes wrong because of bankruptcy searches.
