Amazon marketplace- nightmare seller

I bought a Samsung 32 inch free view television from a seller on Amazon marketplace. When it arrived, it had a 2 pin continental plug on. When I contacted them via Amazon message service, they said it was because they were manufactured in Europe but they would send me a permanent adapter. I wasn't very happy and wrote back asking to return it, and mentioned it was from a warehouse clearance depot according to the label., and I wasn't happy about that either. They wrote back and said the clearance warehouse was just a company name, and didn't even refer to the fact I said I wanted to return it. I eventually plugged the thing it, and it gave me the choice of three countries to choose from, Germany, Switzerland or Austria. By now, I realised I had a real problem, the TV wasn't even intended for the UK market and the seller was obviously being obstructive in dealing with my request to return it. So I wrote again, forcefully saying I wanted to cancel the sale, return the item, and that I had that right under the SOG Act. They ignored me. A week later, I spoke to a Trading Standards Advisor at CAB who advised me to write to them with pen and paper and send it recorded delivery. I was told to quote they had breached the SOG act on 2 counts: 1) They hadn't given me my consumer rights and 2) they had sold me an item not fit for purpose. I posted that, and they signed for it the following day. A week later, still no contact from them. I rang CAB again, she said to send a second recorded delivery letter, and also one to my credit card supplier to make a section 75 claim. I sent both of those on 1st August, the trader signed for the letter the next day, and still he has ignored me. The recorded delivery letter to my credit card company seems to have got lost, so I sent them a normal 1st class letter and they haven't responded either. I phoned them up today and said I wanted to claim under section 75, she said they would send the forms out, but I may not get a full refund. Meanwhile, this trader must be thinking he has got away with it, and I am beginning to think he has too. It doesn't sound very hopeful I will get my money back from cc supplier and I don't know where I go or what I do next, I have had enough of it now, it's getting me down. Any advice very, very gratefully accepted

When I've had problems with faulty market place goods I've always contacted Amazon if the seller refuses a refund, Amazon have always issued a refund.0

Well at last I have found how to contact Amazon themselves. If I file a claim, they just send it straight off to the seller, who ignores it. Anyway I have written to them and explained it so hopefully they will sort something out.

I am more surprised the Trading Standards Officer at CAB (Does one exist?) advised you to say the TV was not fit for purpose. It clearly was.0

If you open a proper A to Z claim the seller has no choice, Amazon will force the issue.Did you use Pay Pal to purchase ??

Thanks for your replies. I have now filed an A-Z claim with Amazon and they have responded in a most helpful way. It should take a couple of weeks to sort out, but at last I feel I can see an end to it.0

In what sense is a TV that is illegally sold with the wrong plug, and which doesn't support setting up for use in the UK fit for purpose under UK law?0 -

1 CHECK FEEDBACK BY CLICKING ON THE %AGE NUMBER BY SELLERS BAME. ESP IF LESS THAN 98%.
2 KNOW THAT AMZ HAVE A CLAIMS PROCESS CALLED THE A-Z GUANTEE IN PLACE & THAT YOU HAVE 45 DAYS TO OPEN UP ONE. THE LINK IS FOUND ON YOUR BUYERS ACCOUNT PAGE WHERE THE ORDERS ARE. LOCATE CORRECT ORDER, HOVER MOUSE OVER LINK TO RIGHT OF ORDER & PICK A-Z OPTION.
If seller does not respond within 7 days you will get all money back from amz, who then debit sellers account.0 -

Not illegal if the send an adapter0
