  • Haha they asked to take my pic but I couldn't make it but I'm quoted in the press. Xercise4less blocked me on twitter so I must have been having an impact with my complaining.
    VCS have shot themselves in the foot and lost a contract by chasing gym members for money though they had proof they were in the gym.what kind of business model is that?
    Both companies involved actions beggar belief and are amatuerish.

    we totally agree, its their greed that is their undoing every time, which you see with VCS daily at JLA as well , plus their sister company Excel at the Peel centre in stockport

    people are learning to fightback and the internet and forums are the best tool to do so , they dont like the template letters and yet use them themselves - awwww diddums

    if there were ever 5 popla appeals I want somebody to win, just on moral grounds, its these (and the ones submitted by the other members there too)
  • To be honest ...when I 1st received the pcn's I was very stressed in life and this just made things worse. But thanks to the good people giving advice on here it prompted me to fight back..and almost make it enjoyable if that makes sense?
    At 1st it crossed my mind to pay the £50 cancellation offer to make it go away...I'm so glad I didn't because VCS have been sacked off.
    Anyway redx and coupon mad etc...keep it up..you are invaluable in making this process we are thrust into less daunting.

    its made sense ever since their sister company Excel upset a close relative of mine 14 months ago , we won that one at popla and I stayed around to learn more and to help others to beat them, to teach them a lesson , cost them money and its immensely rewarding to see the victorys daily on here too

    PE then tried it on with another relative 12 months ago, so we saw them off at the initial appeal stage, they didnt even pursue it at popla, but we had receipts for shops on that day and it was a free car park too , slam dunk as I now know

    by annoying people in this way, the word spreads and more and more people get wise to it, they help others who arent up on the game as yet and before you know it we make a sizeable dent in their scorelines and revenues

    so yes, we do know that "enjoyment" feeling, which will increase when you get the 5 wins and especially if your fellow gym members get theirs too

    i have an update and i dont know how i feel about it.

    The Xercise4less CEO has updated me that they have an agreement in principle with VCS to cancel the tickets. Though nothing in writing to date.
    As much as im glad it is a worry off..( not that im worried now but i was at 1st).
    Id be annoyed if VCS dont have to pay the costs of the appeal to POPLA. But i suppose i can take satisfaction that we as GYM members kicked off to the point the GYM cancelled the agreement with VCS (the VCS contract only started 2 months ago they messed it up that much).
    I still maintain the GYM are the main culprit in this for bringing such a Rabid company in..so thats my next email campaign to the CEO so i can be released from my contract without penalty..which they wont at the moment.

  • coupon - mad to be honest , you seem confident we can beat them at POPLA , so im quite comfortable to let it run its course and cost VCS money.
  • im in touch with another GYM member who says he lost at POPLA and paid up £100. So if he allegedly committed the same offence and has his appeal rejected , but i have mine upheld. Doesnt it make a mockery of the whole set up?
    Thanks to the people on here who are in the know....its basically a game of words.

    Yes it does, and no it doesn't. The system (POPLA) is flawed but is the only system available (for BPA member PPCs). HIS problem will have been he used a mitigation-based appeal (what happened) whereas YOU used a legal-based appeal ... POPLA say on their website that they don't consider mitigation.*

    * But that's a whole other discussion - how could people without internet access know this?
  • BOD1467 - there will be people who dont understand what mitigation is. And expect a reasoned arguement will suffice. Sigh
