Laptop broken out of warranty

Ok experts need advice before I go to Currys and start tearing strips of whoever is unfortunate enough to talk to me first. The laptop was bought in April last year and it has developed a major fault, when my daughter was using it the charger point on the laptop over heated and started melting the plastic around it. It was only on charge for an hour this morning before it happened. The charger is a genuine charger for the laptop and nothing has been changed or modified in it since I bought it. When I purchased the laptop it was a refurbished model and it is a HP Pavillion laptop. Any advice or questions would be great.

you are now in the realms of having to prove its a manufacturing defect and using the small claims service (MCOL) as a threat for redress (up to 6 years in england and wales , 5 in scotland)
ie:- proving it is of merchantable quality and should last longer than any guarantee , also depends on what the warranty or guarantee of the manufacturer says as some may have a period longer than 1 year
so I would say that if the shop doesnt play ball you would have to get an independent report done and possibly go to MCOL to get redress against the shop as the equipment should "last" longer than say 18 months and possibly up to 6 years when the statute runs out
it also helps if you know there are other models with similar issues, or if any recall was applied0 -

My advice would be not to do this! Pretty much guaranteed to achieve nothing other than the lasting ire of the staff.

My Advice is to not do this.
Take it back, see what they say and then come back and ask for advice.
The onus is on you to prove the fault is inherent. They may not require this of you if you are civil and the situation is as obvious as you describe.0 -
not sure how to add a photo of the damage so cant do that right now. I will go up and speak to them in a civil way and see what they suggest, I reckon it will be a response of 'yes leave it here and we can fix it, for a price' it will probably be passed off as user damage would could be true as its a 10 year old girls laptop.
I think I got a 12 month warranty with the laptop, its always had an issue of being very noisy, the fan is really loud and I just took it as being normal. We have another of these laptops here and the fan is quite noisy but nothing to the extent of the melted one.
Ive seen a few websites on line saying about issues with the Laptop and having overheating issues.

dont see the relevance in pointing out that its a refurbished model over 12 months old. It should still be fit for purpose regardless of it being a refurb or not. Why offer for sale a refurb model if it wont last, I know it wont last as long as perhaps a brand new laptop but even still less than 18 months isnt great.0

Might be worth checking the warranty. My OH has a HP pavillion that came with 2 years warranty.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

It could well be a very relevant point.
Yes, the laptop should still be durable and last a reasonable time, but as you have had the laptop for about 16 months and the previous owner may well have had it for a fair time, this might mean that even if there was a 2 year manufacturers warranty, this has now expired.
It is also somethimes the case that a warranty is only valid for the first purchaser or is invalidated for refurbished machines unless refurbed by the manufacturer themselves.0 -
Says a lot about modern society that people deem it OK to 'tear a strip' off what is probably a chap on minimum wage, zero hours contract trying to make ends meet.
Why not deal with the person like a normal human being? You'll probably get further, and you won't make yourself out to be a massive tool in the process.0
