What you may not have considered is that this person may have autism/aspergers. It's hard enough for most people to read subtle communications through plain text. You haven't a hope if someone is on the spectrum. It's a possibility, rather than laziness or stupidity.

Absolutely right Jinus. What is this 'subtle communication' that you are talking about?

I am a uni student being fined now £160 from Debt Recovery Plus from UKPC.
I overstayed at macdonals by 12 mins. I was a paying customer. I stayed becuase I was having a mental breakdown and it was NOT safe for me to drive. i cannot believe this. i have proof of my purchases and also proof of my mental health history.
I missed the 28 day appeal period. i sent them an email a few days ago saying im not paying i was just trying to keep myself safe.
I also called DRP and said i cannot pay this. they said in 4 days they will start the court process.
please can someone help i am nervous and dont know what to do
sorry if this isnt where im meant to post a thread

Did you even read the very first post in this thread? (Based on your post above then I presume the answer is No, otherwise you wouldn't have asked).

#1 You haven't been fined, it's an invoice for an alleged contractual charge
#2 DRP can't do anything (which you'd know if you'd bothered even reading the first post) ... DRP cannot take you to court - at all; UKPC are unlikely to do so.
#3 NEVER EVER EVER phone a debt collector (or even UKPC)
#4 Start your own new thread (after first reading the NEWBIES sticky thread) if you still need help.
  • Just want to clarify that i can ignore a letter from DCBL that has the words "this case is not subject to high court or bailiff action" on the back page? The issue was a parking fine from 2014 and they have written to me twice in the last 3 weeks. I have spoke to them (between the 2 letters arriving) and they were not very helpful. They told me that CP Plus had forwarded the parking debt to them.

Why don't you "clarify" by reading the post above yours, but just to point you in the right direction; as the "fine" invoice is in its 6th year they are trying intimidation to get you to pay up before it times out. But you would know this if you read the newbies thread, where you would also know that you never ever phone debt collectors either!
  • Hi,
I do see newbies sticky and info and will proceed however, I have made some what you would say newbie errors. My question is do the same rules apply?

    1. Appealed through POPLA was rejected in Feb/March for 'not parking within bay'. Still didn't want to pay of course and forgot all about it due to covid nonesense, and then DRP had the wrong address for me as I only received another letter when it has now been passed to CST law with the wrong address on top (wrong number) requesting payment 31st August, when I only received the letter today (01/09/2020)

    2. I phoned them (BOO SORRY I KNOW NOW), and asked how they got £170 fine, this was due to me not paying on time yada yada, explained address error. Offered me 3 month plan and reduction I of course said I won't be paying today.

    3. Can I still proceed as other cases or have I ballsed anything up with current proceedings? E.g is it worth sending SAR etc and standard letters? Do I need to proceed differently, abuse of process etc

NEWBIES - HOW TO UPLOAD LINKS TO PHOTOS/SCANS TO MSE

To upload a photo/scan link, you first need to host it on a free photo hosting site (like Dropbox, Imurg or Tinypic), copy the URL, paste it here, but change the http to hxxp and we'll do the conversion. Newbies can't directly upload links to photos/scans until they've a few posts under their belt.
