Gap Insurance

Hi
I bought a car about 2 years ago i took out GAP insurance for it.£399.00
I then went home thought about it and decided that i could not afford the GAP insurance so i sent a recorded delivery letter informing them that i which to cancel the insurance 29/08/2012.
I then went about my business and forgot all bout it .Yesterday 07/08/2014 i was going through my papers and i remembered that i had never received any refund,so i got on to them (Premiasolutions) They informed me that the policy was still running and they would cancel it for me which meant i would have a refund of £80.00.
I informed them that i had sent them a recorded letter a while back wishing to cancel , and i said i would scan the receipt and send it them .
I got an email this morning saying that they cant accept this as prof of receipt.
and would only cancel from today .
Can i hold them to this receipt and go to small claims if they refuse to honor this.

    No. You appear to have shown them the receipt for your purchase from the Post Office.

    Just send them the proof of delivery and you will be OK.

    Sorry when i say receipt i mean it had tracking number on it and post code of were it was going

    Yes, that's what I understood you to mean, but that isn't the same as proof of delivery, is it?

    Do you have proof of delivery or not?

    Sorry when i say receipt i mean it had tracking number on it and post code of were it was going, what other way could i show that it was posted apart from the post office receipt?which is all i got at thg post office.

    Did you send it recorded, or did you just get a free certificate of posting? If recorded is their a signature of receipt? (You should be able to access the POD, unless the tracking number has been reused).

    Either way, the document is presumed delivered 2 working days (for first class) after posting irrespective of whether or not the recipient received it. (Interpretations Act 1978).

    Well put it into Royal Mial, some stay there for years, and take a copy.

    Ask them again, if not a Letter Before Action

    Yes the document was sent recorded and i paid for it i received a receipt with a tracking number on it which i still have. i sent this to the company but they will not accept it as prof of sending

    Are you talking about my reply?

    If so, yes, you have proof of posting.

    Proof of delivery is something else.

    Others have suggested that POD may still be available.

    Being pedantic but what you have is a proof of postage - that combined with the signature (can normally be obtained on the royal mail tracking page) would be proof of delivery.

    Have you got a copy of the signature?
