Am i going to be santioned tomorror for not haing money to pay for childcare

    It cant get worse for me as im skint my DDs come out tomorrow with no money to pay them so when I recieve other benefits im still broke and overdrawn plus fees and I dont qualify for finacial help:mad:

    As a single parent with a young child you have the right to be given 7 days notice (if needed) to attend an interview and 28 days to start a job. The extra time is given to allow you to be able to arrange childcare.

    You also have the right to restrict your hours to working school hours but not term times only (this does not include travel time to and from work). Therefore you have the right to work from 9-3 ish depending on your sons school times.

    With the above in mind you should not be sanctioned. I didn't read anywhere that you actually accepted the job? If you didn't formally accept it then if the hours were more than school hours (think I read they were) you do not have to accept it.

    You should not be sanctioned as you were not given enough time to arrange childcare to start working and the job hours were outside what you are allowed to work.
    I know what your saying is true, but I just have no faith in JCP DWP A4E they lie, to save their own jobs - I think I may hace screwed myself by not just allowing them to sanction me in the begining as far as the employer is concered i was not working for her the day was a look-see to see if I could do the job if she could find the hrs for me 10-2pm - and i did a back to work calculator myself, travel costs e.london would make me worse off and I wouldnt have paid for childcare.

    If you are struggling why aren't you claiming DLA for your son ?
    Once you do get a job tax credits are paid at a higher level if you have a child either entitled to DLA or with a claim in process.

    But I had spoken to my a4e advisor after leaving wrk and he still sent the req to DWP nowing that I wasnt working, and it would have been impossible for my to have worked 16hrs on the first day as I got there 12.45 and left at 2.30pm and spoke to him the next morning at 10am when the employer sent me home

    But you've just contradicted yourself 'I spoken to my a4e advisor after leaving wrk and he still sent the req knowing that I wasn't working'. It was the plan,therefore he notified. Times cross over, it happens. Don't see it as malicious, it just crossed over. It won't help you if you see everything as a ploy against you.


    None of that matters though as you should not be sanctioned.


    With regards to your circumstances though, if your child has care needs appropriate for DLA remember that being a carer will mean you are not pushed into looking for employment or being pushed into doing unsuitable hours for your circumstances

    And if the child is awarded mid or high care, the OP can then claim income support and won't need to attend A4E.

    with JCP im meant to do 3 job searches per week, look for 16hrs between 10-2pm but my a4e advisor doesnt care

    I seem to remember that once you're at the work programme, your JSA agreement is invalid or something. Were you ever given an action plan or similar when you started at A4E?

    those hours/searches are very generous even for a single parent, I would guess they were put in place as your son has special requirements.

    A4E have to go by the same rules, they cannot sanction you as the job was outside your agreed terms.

    I was told it still stands or at least the rules for single parents still do, they have to comply with them.

    Ive been told he meets criteria for for HRC + HRM and id get carers, but Im fighting his school and LEA re statementing him, and trying to deal with a4e
    I applied for the form in May but DLA office advised me to wait for diag. appt in July, as un-diag claims were being rejected or being put to the bottom of the pile as theres a backlog and if he was accepted I would have to re-apply every three mnths, he has now been diag. on 21/7 only took 6yrs, so thats my next task.
