I have just gone to the Ombudsman over this, as feeling to wait this long is not acceptable. They have known since last August and I am sure if it was the other way round they would have taken the money very quickly. Will keep you updated.0

Sadly I would not hold much hope with the FOS, I did the same, I raised a complaint regarding the length of time first direct where taking to deal with the issues, given the FOS is supposed to look at what is fair and reasonable I argued that if tables where turned then the bank would be demanding the money from me and probably ruining my credit profile in the process,
FOS found in first directs favour, Basically saying first direct and hsbc have said they are adhering to the FCA guidelines therefore the FOS can't comment if this is reasonable or fair, pi$$ poor response to be honest, I have appealed to the final ombudsman but this can take 6 months.
I do think that the FOS seems to be an utter pointless organisation,0 -
Evening All,
Following reading this thread today, i've been doing some research for my Husband.
He took out a HSBC Graduate Loan for roughly 6k to pay for a car. He's since moved addresses a few times and banks, but i've found the receipt for his car payment, which he used the loan money for, and it's dated 12th June 2010. It was paid off in June 2013 I think.
So, am I correct in thinking he maybe effected? He has no annual statements that we can find at the moment to check the wording of them.

I am going to go down the route that HSCB are deliberately delaying payments so they can keep getting the interest on this money. They have known since last August, I received a refund on a small open loan in December. I fail to see how it can take this long. If everyone goes to the Ombudsman they make take it more seriously. The bank have actually confirmed that they owe me the money as well.0

I agree with you happy53. My OH sent a secure message from his account area, got some long winded response that gave no clarification as to whether his loan was affected or not really. So, he phoned the customer service number, and lodged a complaint so should hear back within 5 days. We shall see if that materialises!0 -

I have been fairly patient so far waiting for this letter to come through, but the longer it is, the more agitated it is making me. I want to complain, but know there is no point, as it wont change anything. My wife got her payment at the start of the year, as her loan was open and had a few months remaining. Perhaps the wait is due to them having to work out the interest owed to us on the money since respective loans were closed therefore = bigger windfall. If anything comes through, will keep everyone posted!

I asked HSBC where's my money for the second time last week and also if I qualify. Their response was someone will be in touch. Well no one has been in touch. I'm making my final loan payment tomorrow. Then I guess I'll be classed as part of the closed loans group. Bummer!0
