    Why does 7 come before 6 in these letters?
  • Waiting the gate opening, I've checked my email once mite.
    I've received the acknowledgment letter from popla and they have scheduled a date for the hearing.

    Quite concerned here. Should I attend the hearing too? Would that be in front of a judge?

    Apologies if these may seem silly questions.

    This not a court of law. It's just some legally trained employee at POPLA reading the evidence in their office and then deciding the outcome. Neither side attends.

    Why does 7 come before 6 in these letters?
    -because it is quoting Clause and sub-clause from the cited doc. i.e. BPA Code of Practice. now italicised.
    andrea was already aware of this. Posted in haste gives her a chance to view at airport.

    Nope it's a decision they make and email back - easy! No hearing, no Judge, no attendance needed by you. Do check your emails in case CEL send you a copy of their 'evidence' - which they are required to do sometime before the decision. If you are back in this Country you could then seize the chance to email POPLA a rebuttal of anything CEL say in their 'evidence' but that's not for a month.

    So have a happy holiday and forget it!

    So, I received today an email from POPLA, providing me CEL evidence.

    Four or five pages as far as I remember of answer, in which CEL try to dismiss all it has been provided in my letter to POPLA.
    They have provided photographic evidence about the site, with one picture that doesn't corresponds to what I've seen, and another that has been clearly taken with some artificial light on (on a normal light condition the label can't be seen as clear as in the picture).

    It's funny their opening ... "As far as you are sure this letter is a stencil download from the internet"

    Whereas in their conclusive note, they refer to the following POPLA decision to deny my points: 1411054537,1411434537,1411054532 and 1411604515.

    Please note that as far as I can see, once again the photographic evidence provided doesn't show any date when these have been taken, and IMHO as far as I remember since my visit I have the sensation there are more signs than those I remember.

    In addition, it is very evident they have now replaced a sign at the entrance replacing the "this is a private car park owned by the hotel" with a sign including T&C. This was not there at the time I went on the site.
    And, funny enough, this sign can be immediately seen only if a driver comes from the right side of the road, not from the left one.

    So, I have a chance to make a rebuttal? Shall I?
    If so, what should I need to do?
    Wouldn't be easier to upload here or somewhere their answer?

    APPEAL DATE is on or immediately after the 17th of September.

    Always pick our the things you disagree with and rebut them to POPLA.
    I suspect the cases they refer to will be old ones!
    Do a forum search for evidence rebuttal or cel rebuttal and see what you can find to help you.

  • I would appreciate some help in writing whenever possible. Should I go for a long letter like the one I found?

    Or a shorter version would be ok? There are some bits and pieces referring to specific regulations that I won't be able to cover due to my limited knowledge in the "industry".
