Warwick fine for parking in a private car park

    Hello there,
    As expected Civil Enforcement Ltd returned a letter saying they won't cancel the PCN.

    They say that the PCN has been raised on the basis of a "Contract Law", and that the driver infringed the T&C that states "payment must be done not later than 10 minutes from the arrival", which it went past of 1 minute and 30 seconds in the driver circumstance.

    Additionally, it must be said that no signage was visible at the entrance about the 10 minutes enforcement. If the driver saw that, I am sure he would have paid straight away.

    They have included a proof of this signage attaching a coloured print of the ticket machine, with the signage at the back. No dates are print on the photo, so this could have been taken even 3 years ago as a matter of fact.

    They say that due to the Data Protection Act they can't include any details about their client nor the contract in place.

    I have been given a POPLA code number and offered additional 14 days to pay the PCN.

    so lets see if they can now prove this to POPLA after your appeal is heard, and see if POPLA accept it or believe it all to be hogwash and rule in your favour (I think the latter)

    look forward to reading YOUR COMMENTS when you have won this and proved the CEL appeal refusal isnt worth the paper its written on , same as a lot of them they fail to take to court like the co-op ones they drop out of, or the one last week they failed to show up for

    be quite funny if they do a PSDSU and dont send in any evidence pack, or cancel after seeing your popla appeal

    Actually, few more questions:

    a) Do I need to include the original receipt of the paid parking. I've mentioned this in the GEOPL
    b) Should I include a copy of the photographic evidence CEL posted?
    c) Should I include a copy of both the original PCN and the Response to representation?

    And actually there is another POPLA appeal, which I just found including the following:

    The following events are accepted:
    The vehicle entered the car park at 9.45am and left at 10.20am on 1 November 2013.
    The Parking Charge notice was issued on 5 November 2013.
    Letter received from ParkingEye acknowledging receipt of my appeal on 20 November 2013.
    Letter rejecting my appeal dated 29 January 2014 was received on 1 February 2014

    Should I include something like this, adapting to my circumstances too?

    A copy of receipt (ie a photo you can upload will be fine in evidence you send) yes.
    B) and c) No.
    And don't bother making any more changes.

    As a non-native your English comes across well. However if ever you need help again it might be worth mentioning early on, so that we can adapt the way we say things if appropriate. I don't mean that to come across as patronising, but sometimes I know I use language that for a non native speaker might be difficult to understand and I would make an extra effort to be clearer if it is necessary.

    Thanks. I am making an effort to improve it, both written and spoken. Still lot to learn though.

    Very appreciated, and in fact I would be a liar if I tell you I did read some paragraphs only once. Some of them have been read twice or more because I wasn't sure of what I was reading.

    Well, it looks like I have a problem with the verification code on POPLA site.
    Although the site suggested to verify the code state this is correct, on the POPLA site this is not recognized.

    What should I do now?

    And it's not a browser issue as I tried two different ones.

    persevere as sometimes people have mentioned this has happened recently

    also try opera, chrome , firefox , slimbrowser etc in case the different browser idea works

    if the checker says its ok, its ok , otherwise contact popla tomorrow and complain directly to them so they fix the issue for you

    So having test all my browsers arsenal, I pass for tonight and will give them a call tomorrow.

    Some people were having the same issue last week. It may be gremlins in their system. Try again tomorrow and if you still have no luck, just do the old fashioned thing and post it to them. But make sure you take it to post office and get a free proof of posting.

    Well, working in the IT I don't believe in gremlins here rather than in some mistakes on people system.
    That said the code I have seems slightly different from the usual format.

    The forth digit should be the year, but in my case it's a 2 ... very strange.

    If the best way is to post them avoiding hours on super paid phone number, I am more than happy to go for that avenue. But what would happen if the number I have doesn't exist?

    How soon will I hear back from POPLA (regardless what they have to say)?
