Forestry Commission Scotland - PCN

Hi,

Parking charge notice left on the windscreen of car. It states 'this PCN is issued by Forestry Commission Scotland and processed by ParkingEye Ltd.'

Also states 'if this PCN remains unpaid, Forestry Commission Scotland reserves the right to take further legal steps to recover this payment.'

Previously, I have followed advice (for Scotland) and ignored PCNs issued in supermarket car parks. Just wondering if its the same advice for this.

Any advice greatly appreciated.

    Forestry Commission ticket = possibly issued under byelaws. Depends exactly what it says in toto.

    PCN makes no reference to any byelaws.

    It states:

    'This parking Charge Notice is issued by Forestry Commission Scotland and processed by ParkingEye Ltd, in accordance with our terms and conditions displayed within the car park, which by parking within the car park you agreed to be bound by. ParkingEye Ltd is a member of the Approved operator Scheme and the British Parking Association, and is authorised by Forestry Commission Scotland to process Parking Charge Notices on its behalf.

    If this parking Charge Notice remains unpaid, Forestry Commision Scotland reserves the right to take further legal steps to recover this payment.

    Repeat offenders may be prohibited from accessing this car park in the future, and be liable for further costs.'

  • It begs the question why you didn't pay the parking fee in the first place. It does go toward a fairly worthwhile cause.

    That is an assumption that the OP did not pay for his/her ticket. PE issue tickets for all sorts of things - wheels an inch over white line, no permit, fluttering ticket syndrome, blue badge upside down, etc.

    Dislike the phrase "repeat offenders" suggest a data protection issue, as why should they keep your information on file if you have committed no criminal activity.

    If he ignores them how would they know? The most they can conclude is that it's the same car, they've no idea who's driving on each occasion.

    However, a landowner may exclude who he chooses from his land.

    As far as I am aware Forestry Commission bye-laws apply only in the two former royal forests - The New Forest and the Forest of Dean.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    That would appear to be a mis-reading of the byelaws. The byelaws state that they apply to all Forestry Commission land, it's just that there are certain specific conditions relating to (or not applying to) The New Forest and the Forest of Dean.

    However, this thread isn't about the Forestry Commission, it's about the Forestry Commission Scotland.

    :embarasse Glad someone's on the ball. Thanks Bazster. I was relying on my recollection of well over 30 years ago when I working in the New Forest. Too ancient!

    Thank you for all the replies.

    Looking on the FC Scotland website suggests they are still part of FC (which covers England and Scotland. An internet search for Forestry Commission Scotland byelaws takes you to the FC website and the bylaws state:

    5. No person shall in or on the lands of the Commissioners:-

    (xxxi) wilfully evade payment of any charges or tolls levied by the Commissioners for the use of car parks or forest roads.

    So am I still okay to just ignore this?
