I still do not believe that any bank is under an obligation to recall payments made in error .

Did you read the link I gave? Here it is again:

Or do you think the MSE team are wrong?

As for the account it has gone to, OP has not mentioned the account being closed or the money going to a holding account. - it is possible that the account with the debt is still live and capable of taking payment.

You don't understand how paying a credit card bill works - I never suggested the account is closed, or anything about a holding account. I mentioned a collections account.

    From Barclaycard's website:
Using your bank’s online or telephone service
If you are a Barclays account holder you can pay using Barclays telephone or online banking services. You can also pay using the Barclays Mobile Banking app.
If you are a non-Barclays account holder then you can pay via your respective bank’s telephone and online services.

Our bank details (for phone or online banking payments):
    - Our sort code: 20-04-15
    - Our account number: 38290008
Please make sure you use your card number as the payment reference.

    Source: http://help.barclaycard.co.uk/brochure/paying_bill/pay-my-bill

So when you, the OP or anyone else pays their Barclaycard bill online, they pay money into 20-04-15 38290008. That account belongs to Barclaycard. It's called a collections account.

So it's up to Barclaycard to return the money, because it was paid into their account by mistake.

Last year I posted on here as I accidentally sent in excess of £1000 to HMRC using a link i use to pay my tax instead of my visa account , my bank were not able to recall it even though I was on the phone to them within 5 minutes of making the transfer.

It sounds like your bank were being unhelpful. In any case, the new code requires them to try harder now.

So it's up to Barclaycard to return the money, because it was paid into their account by mistake.

The code basically says Halifax should inform Barclaycard the sender says they sent the money in error and ask for it back. If Barclaycard refuses to return it, Halifax should offer the sender advice about other ways they can attempt to recover it.

Halifax has told the OP that they will "try" to get the money back and that the process may take up to four weeks.

The code says they should take action within two working days and give the OP a final outcome within 20 days (working days? 4 weeks?).

So far Halifax appear to be complying with the code. If Barclaycard won't return the money there isn't much more Halifax can do. Or should be able to do.

I certainly wouldn't want people who have legitimately paid money in to my account to be able to snatch it back after a change of heart/mind.

    Hi Snow Tiger

Fully agree with what you say.

(In my post that you quote, I was challenging Soolin's incorrect suggestions that Halifax can do nothing, and that Barclaycard have no duty to return the money.

It seems that Soolin's own bank told her they could do nothing in similar circumstances, and perhaps she accepted that as fact - which is incorrect, even before the new code of practice.)

Arguably, the OP could also contact Barclaycard now - rather than waiting 20 days - to ask for his money back. It may get quicker results.

Thank you all for your replies

I have made a genuine error which makes me feel sick to the stomach. My bank have written to me and said that they will notify me within 21 days as to the outcome. I am really at their mercy here

Barclaycard have said that they no longer hold the account where the money has gone

My mum did contact the company as Barclaycard told her how to. The debt company said they will not receive the money for up to 6 weeks. They said that I should contact my bank and they should recall it on my behalf and explain the error.

So it looks like Barclaycard have a holding account where the money is being held , it hasn’t reached the end user yet BUT I still can’t get Barclaycard to redirect the money to the correct account.

I have now had a charge on my own Barclaycard the first time ever for a late payment despite notifying Barclaycard of the issues

It is also very hard to talk to Barclaycard when all of the call centre places are overseas. As much as the people try very hard to help you they still can't divert off a script and never fully understand the issue which doesn't help me when i don't have full faith in what they are trying to do or writting on my account

My understanding of these situations (yes mainly based on the news I must add) is that you have a right to get the money back if you've paid in the wrong account but the bank don't have the right to give out customer details...so all they can do is ring them and *ask*them to return it.

Knowing where the money has been paid I would of thought you should get it back...just a matter of keep putting your foot in and time.
People don't know what they want until you show them.

My bank have said they know exactly where the money is and have already started the proceedings to get the money back and are approaching the bank that has the money. It really is just down to wither or not they will return it

    There may be some progress

It turns out the money has been located and is in a holding account for Barclaycard. Barclaycard have said yes we have it and are waiting for my bank to confirm a few details and then hopefully it looks like it is getting resolved and things will be put right

Its not 100% over until the money is either put back in to my account or Barclaycard to an internal transfer of the money in to the correct account but there does look like there is light at the end of the tunnel

Thank you all for the positive advice and thoughts

    Nice one, OP.
In the meantime, do your best to keep up with the minimum repayments to Barclaycard on your own account.
