    So before I send the appeal, I just want to know, in the event Smart Parking do not cancel the ticket if I appeal now, would it really matter that I didn't wait for the Notice to come through? What would be the difference?

    To be fair, not a lot in this case. as regulars say, Smart usually cancel at this stage and don't go to POPLA. It's only if there are later notice to keepers, ones that are non compliant that give a few more grounds for appeal later on,.

    So although for most we say for NTK, in the case of Smart, it seems not to be a problem. Some we actively tell you to appeal before NTK.

    If you want to get this one out of the way, go ahead and appeal as driver.

    None with Smart which is why I went out on a limb & suggested just go ahead and appeal!

    Just follow the instructions you were given. Simple as.
    Not so Smart fold at any structured defence - they earn enough from the gullible to not have to worry about fighting appeals.

    I get around 3 tickets a week from them, and just to prevent the massive volume of debt collector letters (non enforceable) that would bring, I appeal everyone. I'm running out of ideas for vague and pathetic reasons why I shouldn't pay. I cannot get to Popla with them, they just fold.

    So, follow the advice and put this to bed.

    I still haven't heard anything to my appeal, does anyone know how long they take to respond?

    It's pretty feasible, in the case of Smart Perking, that they have already given up. The trouble with all of this stuff is that they have 6 years in which to pursue any alleged debt. However, there's no track record of Smart chasing ancient debt via the courts.

    That said, neither was there any such record on the part of ParkingEye until just over a year ago.

    But the longer the 'silence' continues, the more you might want to consider this could be over - but no one other than the PPC can guarantee that.
