Appeal Refused - What Now?

OK, I admit it: I didn't read the advice before I made my POPLA appeal, and it's been refused. The question is - do I have any options left? I really don't want to pay £100 for 65 minutes parking. Here's what happened...

My father-in-law was seriously ill in Bedford hospital. We parked in a Phone-and-Pay car park run by starpark.co.uk. This means no physical parking ticket is issued - it's all done by an automated phone system.


The signs in the car park looked really clear: four simple steps...


1. Call 0141 404 0000
2. Enter site code 4512
3. Provide credit card details
4. State your vehicle registration number.


My wife did all this, and received a text message confirming Step 4 (the vehicle's registration number).


However, two weeks later we got a £100 parking charge notice in the post, 'cos Steps 1-4 apparently only 'registered' the vehicle, but did not 'complete payment'.We'd thought that the system would just charge our credit card the appropriate amount!!



I thought this would have been a cut-and-dried appeal (I know, I know, I'm naïve) but it was rejected...


Do I have any options???

    now compare that advice with your own appeal and see if you have grounds for a complaint to the lead assessor

    totally depends on the grounds you appealed on (clearly not the correct ones as you lost)

    otherwise no you have no further appeal process and either pay (which we dont advocate), or weather the storm and only deal with an LBC or an MCOL

    You could. Contact you PALS for this hospital and get the it help in cancelling.

    Ignore any debt letters, read newbie thread posts 4 & 5 to see what may follow.

    Which PPC is it?

    If it should go to court, the court unlike PCNs and POPLA will consider mitigating circumstances if appropriate. I strongly suspect should it ever get this far you would have a good case with a proper defence.

    You can ignore any debt collector letters and just defend any court claim. Star Park are Civil Enforcement who like to issue small claims papers but NEVER WIN!

    My appeal was similar to the link that you posted - I think you described that one as a 'dog's breakfast'. I just didn't appreciate what was needed.

    I focused on signage ('cos we did exactly what it said on the sign...), but didn't mention estimate-of-loss' or contract-status.

    So, let me check I've understood this time... Summary.

    1. There may be some possibility of some kind of a super-appeal at POPLA, though it's unlikely 'cos I didn't do my original appeal rigorously enough.

    2. I can expect to be bombarded with debt-collection letters, which I robustly refute, then ignore.

    3. [This is the bit I'm not sure of..]. Eventually I'll be summoned to Small Claims Court ?? or MCOL ??

    Hi Joe,

    There is a glossary in post #2 of the NEWBIES threads.

    MCOL is Money Claim On-line - the governments on line service for initiating a court claim and perhaps needs to be added to the list.

    PALS - Patient Advice an Liaison Services - as this is a general acronym relating to hospital services it wouldn't be included in a glossary for terms relating to parking tickets
