    Don't forget the packaging has gone as well.

    How many of us would be happy to buy an new unused tumble dryer that wasn't in a box?

    True, buts that’s them to solve. I didn’t ask for the packaging to be removed and certainly was not happy to see the machine going upstairs without it. Who tells me the machine was not used in the first place? It had water inside.

    Would it not be easier to simply not use it while you are sleeping? Not many tumble driers are designed to operate in a bedroom while sleeping so noise is going to be an issue with many.

    Surely that is preferable than losing anything on returning it?

    We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

    Now I ask: What or who decides what is considered unnecessary handling?

    It is not strictly defined in law so a judge would have to make a decision based on the individual case. The law does state the following as an attempt to provide some guidance.
    (12)!For the purposes of paragraph (9) handling is beyond what is necessary to establish the nature, characteristics and functioning of the goods if, in particular, it goes beyond the sort of handling that might reasonably be allowed in a shop.

    Of course, this just raises the question of what is allowed in a shop (some might be stricter than others). Again, that would be for a judge to decide.

    As I said in an earlier post, how many established bricks & mortar retailers offer the chance to see tumble dryers in use?

    A bit late now but the spec of whirlpool machine gives you a noise rating in decibels.

    In your first post you say it wouldn't fit through the front door with the packaging on.
    Do you expect them to magic it through the door? The door being too small isn't their fault.

    Brilliant news,

    I called whirlpool and have been told that the noise was caused by the condensation pump. Apparently the level float got stuck during transit and the pump was working dry making a very odd noise.

    So this means I wont have to return the appliance as its working normally now. I wish to thank those that helped anyway, in future I might do things a bit differently.

    And thankfully I wont have to cut my front door or quit my night time job :beer:
