Prior to last month you would have been able to return the items under the Distance Selling Regulations and only been liable for the cost of returning the goods.

This has now been superseded by the Consumer Contracts Regulations. I am not that familiar with all the ins and outs, but I believe they can make a deduction for the diminished value (i.e. they can no longer sell it as new).

I am slightly confused in that you say you have not used it, but it is louder than you thought. Surely you HAVE used it to know how loud it is?

Thank you. That is probably the reason and i appreciate your time sharing this.

I plugged and operated the machine empty, as one would technically be able to do at a shop, therefore I don’t believe that would diminish the retail value. The definition of using involves placing fabrics inside which would leave particles and cause wear inside

    For all the others:

Lets avoid getting into discussions or off-topic.

The reason I opened a topic was to know what is the legality that I wont be able to return the item just because I plugged it into a socket to verify operation. I could otherwise, just needed to say I changed my mind. The fact I gave a reason is not relevant at all.

Fair point.. Can you advise OP?

Yes, it was. That's why I am not happy about it.

I could have clarified this issue before purchasing at a store, but obviously when purchased on-line you only get so far as to read the manufacturer specs.

If the noise level of the machine was a primary concern when selecting the dryer why didn't you ask the seller to switch on the showroom model so that you could determine whether it met your expectations before you purchased it?

I could not find this particular appliance on a showroom so I had to order it on-line

Was it bought 'at a distance'?

cts_casemod - the above is an important question. Did you purchase in store, online or over the phone? The laws regarding your ability to make a change of mind return depend upon this point.

The retailer is not permitted to retain money for the outbound delivery. A guide can be found here:

My point is: I would not buy a car without being able to road test it, to make sure it meets my expectations for the particular model in question, even tough the manufacturer gives me a guarantee that it will go from point a to point b.

So does they law say I don’t have the same rights when buying a home appliance?
Who and where did you buy it from, shop or online?
