    Well, that's pretty clear. Nothing in those schedules says anything about a parking permit.


    So, you must TELL the management company and the PPC that they are in no position to be attempt to vary the terms of your lease or to add more conditions to it. You will not accept any additional conditions. And threaten them with the trespass angle as already mentioned.


    The more of your neighbours you can get on board, the better.

    The lease seems pretty standard, but it does not mention sorned vehicles, which some do.

    Daniel, you are in an excellent position to weild a big stick if you are so inclined, you hold all the aces.
    You never know how far you can go until you go too far.

    Warwick Estates were our MA for few years. They unlawfully took over our finances and accounts. Our directors of the time knew nothing and took whatever Warwick Estates said as gospel.
    After two court cases and a case at the Leasehold Valuation Tribunal, a long overdue AGM was held and new directors appointed.

    Inspection of the accounts showed many 'errors'. We are now in the process of recovering around £40,000 from Warwick Estates.
    We already have a favourable decision by The Property Ombudsman. :)

    Thanks guys! Looks like I have my plan of action with regards the parking situation... Sadly it also seems I have another nightmare management company to deal with.

    You say that you own the flat (rather than rent), which makes it easier. You also state that your parking space is a specific, numbered, allocated space, which effectively makes it YOUR property.


    As long as your lease doesn't allow the management company to make arbitrary changes and impositions like this (unlikely, but check), you need to write to them and state:


    Your parking space is yours. The management company have no authority to impose additional requirements on you around how you use that space. You do not accept any permit scheme. You will not be displaying a permit. If their agent, i.e. the PPC, come onto your property and attach any kind of ticket to your car, that will be treated as a trespass on your property and they (the management company) will be held fully responsible.

    I'm reading through the lease now but can't see anything so far about changes being made.

    Oh great! Solitaire / OM were bad enough, making us pay for quarterly electrical inspections of the entire block at £880+vat four times per year, refusing to bother to change electricity suppliers despite me finding a solution that would save £3000+ per year, bypassing the light sensors to leave the lights on 24/7 because the sensors apparently caused bulbs to blow (cost of average 12 bulbs per month = £120 Vs cost of increased electricity usage of around +100 units per day = £300....do the math!). A lift that breaks down so often (from day 1 I might add) it costs around £8000 per year to maintain and we just have to keep paying our charges. tbh the list is endless. When I signed my lease, the current monthly charges were £100 - within 4 years they doubled!

    I've asked Warwick for copies of all invoices relating to the last financial period July13-June14 and have been told they will get them to me.

    Based on our experience, your parking issue could be just tip of the iceberg.
    With us and a few other blocks I know, first thing WE does is to take over the finances and accounts. Managing agents are disqualified to prepare accounts under the L&T Act Section 28.
    Appoint an independent accountant and have the accounts audited.
    Well worth the extra cost, IMO.

    I suggest you team up with other leaseholders. Don't you have a residents association or company of some sort?
    Managing Agent is only an agent employed by whoever appointed them.
    The agent should take directions from you and not the other way around.

    You need to check either in the lease or with the landowner/management company contract exactly what powers the agent has. It is often in there that the problem lies.

    If that confers the right to introduce such measures that they deem fit to manage the landowner's property and land, then you can see the problem.

    If you've already exercised your right to manage and this management company has effectively been hired by you, the leaseholders, it ought to be relatively easy to kick them out.
