"Exceeds marked bay area" Not an overstay...

Hi All,

I have read the newbie thread and am still a little confused. Most PCN's I see on here relate to overstays or similar.

I have parked in a car park that is partly a "normal" car park with designated short stay bays in, and the other side of the car park is just gravel and around the perimeter are vertical white lines painted on the wooden walls. There are signs that state "please park between the white lines"
I did this - but at a slight angle. I always reverse park and the rear of my car is between the lines. The angle I parked at was not significantly worse than other people in the car park, and did not obstruct the "bay" next to me. - There were many, many free spaces in the car park.

I paid and displayed. :)

I am confused as to their request. If a bay doesn't exist, how can I exceed it?

I would understand if multiple vehicles had been ticketed but they had not. In fact, the gravel "waste land" part of the car park is so large, that people create their own row down the middle of it. I have parked here before and in this case there were cars parked there in this manner at the time. NONE of them had a PCN on their vehicles and I assume this is because it generates more money!!

The car park is not owned by a shop. It is the car park of a small theatre. I imagine the owners/people in charge of the building asked PPS to "look after" their land without knowing their tactics!

We take our daughter to dance lessons at the Atheneum. This was the reason for us parking here as we do every Saturday morning. No receipts etc, but I'm not trying to demonstrate a reason for an overstay as that's not what the PCN is about...

I have read their scary notice. It was a windscreen ticket. I know the new advice is not to ignore it, but do I wait? It states the usual "£100 reduced to £60 within 14 days" but also states that if I appeal within the 14 days that regardless of the appeal decision I would be liable for £60.

Is the advice to wait for a NTK to arrive through the post before appealing?

    Wait for the NTK. Whilst you are doing that, read the Sticky thread for Newbies at the top of the page as this will tell youeverything you need to know on how to win an appeal. Forget about where and how you parked,it is irrelevant.
    You appeal on the main points detailed in the sticky thread, including the sure fire GPEOL.

    Also complain to the owners, tell them you payed and displayed and ask why their agents are harrassing you.

    As above. Just make sure it is not one of the small PPCs that don't always send NTKs but go straight to debt stage. Check back if unsure.

    Would you mind just confirming who the PPC is please (full name, not just initials)? I can see a 'PPS' mentioned but as that is so close to 'PPC', it could be a typo.

    When we know exactly who you/we are dealing with then advice can be better tailored for you.

    Ooooh you definitely want to wait for their first letter then because I seem to recall they don't use a compliant Notice to keeper (which then becomes an appeal point at POPLA stage among the others). You can send the usual template appeal at the first stage once you get whatever they call the first letter.

    Also do NOT just send off a generic POPLA appeal when you get to that stage - please at that time, REMIND us that it's PPS because they have actually won a couple of POPLA appeals by massaging their GPEOL statement to suit what POPLA want.

    Would it be useful to upload a picture (of the car park) to show you how the bays are supposedly marked?

    I am not aware that anyone has been offered this, however I am sure a few people have proposed to Coupon-Mad!
    Interestingly enough, I actually keep my charity hat off on this forum. I work for one and am always aware of how much charities could benefit if we suggested a small donation to them if you succeed in appeals as a direct result of the forum. But then it would look like we were doing it my for gain and that is very. Not the case.

    So it is better not to muddy the waters. However if people chose to do something for a local charity in private, then that is great.

    :D Not proposals - I am a married woman after all!

    I'm happy to help any poster for free but have been sent the odd small Amazon e-voucher and several people have sent a small donation to pepipoo forum where I post as SchoolRunMum. It's a smaller forum which helps shedloads of people with private and Council tickets (winning almost every time with the latter and of course, like us here, all the time with the former). Pepipoo deserve the donation money as they do such a terrific job:
