UKPC, DRP Debt Collector, Urgent :(

Hi there,

I'm in a bit of a mess and need urgent help regarding a parking ticket...I've read through the guidelines and other posts, however this has already escalated without my knowledge, as all letters have been sent to my previous address, from which I have only just been able to collect mail spanning the last 3 months.

I received a PCN on 14th April 2014, at a private housing development. I had a temporary permit to park there, which ran out at 10am. While the ticket was issued (at 10.15am) I was actually with the estate agent, sorting out a long term parking permit (valid from that day), and have an email to confirm this.

Since moving to my new address in April, I updated my address with the DVLA and received my new driving licence, so I expected the NTK to come to my new address. However, the NTK plus 2 letters from DRP debt collectors (dated 13/06/14 and 30/06/14) went to my old address, where I lived with my now ex-partner. The latest letter from DRP states that if I don't pay £160 by 14/07/14 they will commence court proceedings and that I will be liable for further costs.

I feel that it is unfair that I've been issued this ticket, given that I was organising a permit at the time, and I'm now extremely worried about what might happen if I do not pay £160 by Monday. Obviously they will presume I have been ignoring their correspondence, which is not the case.

Can anyone offer advice in this situation please?

Thanks so much in advance.

Thank you for your super-quick reply. I have read through the sticky, but the problem is that I don't have enough time to send a reply to them, since they want payment by Monday. _pale_

DRP cannot take you to court, its a threatogram with no basis in law

frankly, we dont care what it says and it tells you in that sticky thread all about them, including links, but there is no way you have read through it properly in the short time since I pointed you at it

only UKPC or the landowner can take you to court (MCOL)

you say DRP are threatening you ? with what ? all they are saying is they have given you a deadline to pay an exorbitant amount or they will refer it back to creditor

its designed to make the gullible pay up , but they have no powers to do so

as for your earlier post, you say you changed your driving licence to your new address, irrelevant, its the V5C that has the address of the registered keeper of the vehicle on it, so they obtain that address from the dvla and send paperwork to it (not to any address on your driving license)

so just to be clear on this

YOU DO NOT OWE DRP ONE PENNY

DRP CANNOT MAKE YOU PAY ANY MONEY

DRP paperwork is a threatogram with no laws behind it

DRP CANNOT TAKE YOU TO COURT

now read post #4 of the NEWBIES THREAD AGAIN, PROPERLY THIS TIME

I do not believe it actually says this , seeing as they cannot take you to court

I didn't mean I read it in the short time between posts; I meant I had read it prior to posting. However, I will take extra time now to go through it again more thoroughly. Also, point noted re: V5C; I hadn't realised that was to be updated separately.

Thanks again for your prompt response, much appreciated.

You're right, my bad. it actually says "we will pass your file to the creditor's solicitor with a recommendation to commence court action against you."

I guess in my panic I only took in the latter part of that sentence.

    Thanks again.

well, it didnt look like you took in post #4 at all of that NEWBIES thread, as it does ask people NOT to start a new DRP thread,

see the last post in this thread too https://forums.moneysavingexpert.com/discussion/4864594

now which part of IGNORE DRP is it you need clarified ? lol :)

yes, you must change the V5C as well as the driving license , otherwise they both carry fines from the dvla if they pursue them , so if you didnt change the v5c that explains why letters went to the old address

by all means try the template letter on UKPC but I doubt you will get anywhere

as for the DRP paperwork, you could use it in your loo(e) , or the blue bin if they recycle paperwork in your area (just keep it for 6 years beforehand - the statute on small claims)

UKPC dont do court, at the moment , DRP cannot take you to court anyway, hence the new and correct wording you have now provided

Yawn - debt collector letters. These have been the bane of this forum board for the whole time I have posted here and nothing has ever changed about them:

    http://forums.pepipoo.com/index.php?showtopic=24362

Look at the date of that advice on pepipoo forum - 2007 and it was a 'recurring concern' then too!

All I ask is please don't update this thread with every letter - please! Eeek! They are already discussed to death and I have replied on 3 threads about this issue tonight alone when there was no need - it's sooooo easy to search this forum for the single word 'Recovery' and then you will see why we get so bored by these threads...thousands every year, no new threads ever needed about this issue at all...sorry...bored now! Do the search and you'll understand.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
