PCM-Appeal rejected

Hi All,

I received a ticket from PCM in February and read some old advice to just ignore it. I now know that the law regarding parking changed and I should have appealed at the time.

Having since read the correct advice on this forum this is where I am at...

I sent a letter to PCM using the template from this forum. The reply I received simply states "unfortunately we cannot process your appeal. Your case is now with our Debt Recovery Team"

I also sent the strongly worded letter template to Newlyn Debt Collection at the same time. Not had a reply as yet but it's only been a couple of weeks.

So this is where I am at and I am unsure of my next course of action. At the least I was expecting an appeal reference number so I could take the appeal further. The other issue is that PCM were with the BPA and now seem to be with IPC. from what I understand, i need a reference number to appeal to the IPC, and as they are not the same as POPLA i should seek advice here before doing so.

Hoping someone can advise me. Thanks in advance

    The advice at this stage is to ignore debt recovery lettes who have no power. All this is covered in post 4 of the Newbies thread at the top of this forum. Advice is generally not to contact DRP as it can mean they chase you all the more.

    You should not ignore a LBCC/LBA though, ie an official court letter, not a debt letter threatening court.

    However of you look at these pages you will not find PCM on the list off companies that take people to court, so the chances of them taking you to court are slim to none. So you are safe to sit and ignore and put all the debt letters in a pile to see how high they get.

    Should you get an appeal reference code it would be for the appeal organisation appropriate at the time of your parking event - and if I understand your initial post, this would be POPLA.

    But given the time difference I would say your chance of a POPLA code from the PPC is somewhere between zero and no chance. There's no way they want this to go to independent appeal, because they stand a 100% risk of losing, and having the pleasure of paying £27 for something they know that's coming their way!

    So you now find yourself at the debt collector phase of this. And there's plenty of advice in the NEWBIES sticky - post #4 - to guide you in dealing with this.

    Yep come back if you do get court papers as we will help with any defence needed (rare) but - please - no need to post here about every letter...please...spare us the 'OMG this one looks extra scary' posts every six weeks.

    The forum can help newbies best if you simply use 'search this forum' next to 'forum tools' on page one of this board (just above the sticky threads).

    Put in 'Newlyn' or put in an unusual word from any letter you get so that you can read all the hundreds of times we've already had to answer about that letter chain over the years. The letter chain is tedious beyond belief when you've seen it hundreds of times but we appreciate it's new to you, hence the tip about searching the forum to read about the letter chain. You will bore yourself silly when you search about Newlyn letters. :)
