I have already told you that ParkingEye is in breach of your Code of Practice and that my appeal is deemed accepted. Accordingly there is no further reason for me to contact you or ParkingEye. Hi all, received a letter from PE this morning in response to my email to them, letter is not signed, no named person and no revised date given:
"Thank you for your correspondence in relation to the Parking Charge incurred on 21st June 2014 at 16:17, at Associated British Ports Town Quay (Short Stay) car park.
ParkingEye previously wrote to you on 2nd September outlining the reasons why this Parking Charge had been placed on hold.
We would therefore like to refer you back to this correspondence which makes clear that there are indeed exceptional circumstances surrounding this case. Hence the reason your appeal has not yet been accepted or rejected.
As previously advised, the Parking Charge has been placed on hold and will remain at the discounted value during this time."0 -
Send them a reply saying:
Discounted value' my @rse - your entire modus operandi is valueless to the UK Public and exists merely for your own enrichment. I put you on notice that I consider this matter closed and your continued prevarication is unfair and unwarranted harassment. ParkingEye should have known from October 2012, and certainly did know when losing at POPLA in a case decided about this issue, that there can be no keeper liability on land where byelaws apply. As you know, from 1st October this year (in a few days) the Consumer Protection (Amendment) Regulations 2014 will add three new remedies into the Consumer Protection from Unfair Trading Regulations 2008. If you re-ignite this dead-in-the-water 'charge' and continue to demand money, then I reserve the right to take action against you for unfair and aggressive business practices. It would not surprise me at all if a private parking company is an early casualty to be sued under these new consumer rights and ParkingEye are notoriously aggressive and right up there to be the first. As I said, I consider the matter closed so cease and desist this harassment.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

"Thank you for your e-mail.
Please be advised any action we take against our member is between the BPA and the member. Therefore we will be unable to provide you with the information you require.
Parking Eye have confirmed they will be responding to your appeal."0 -
If this is under investigation by DVLA/Trading Standards, they are unlikely to tell you anything, but keep up the pressure anyway.You never know how far you can go until you go too far.0

Parking Eye have confirmed they will be responding to your appeal."
I've amended this to reflect what was meant to have been written.

yeah true the-deep I didn't expect she'd tell me anything. It's just all very frustrating that my appeal's not been decided yet (I know I'm not the only one) and without a revised date or POPLA code it seems there's no end to this. I think I'm on day 83 now if I've counted correctly from the date of my appeal letter 9.07.14 0 -
