And that justifies the dangerous overtake?

If you have ever been in a suburban environment where junctions are about 100yds apart (every 5-6 houses) and you have been stuck behind a slow learner then you will understand. You have no option but to overtake near a junction because you can't escape them (the junctions)
Well in that circumstance we can both agree you have no option: you have no option but to be less impatient and remain behind the learner.
If it is not safe to overtake then don't overtake.Optimists see a glass half full
Pessimists see a glass half empty
Engineers just see a glass twice the size it needed to be

Oh dear.
You've admitted that visibility is so poor that you cannot see where the junctions are -- and you take that as your cue to overtake another vehicle.

Thanks for all the replies. We've or should I say he's decided to take the advice of your goodselves and go on the awareness course.
Apologies for my first post in not making the situation totally clear but I posted at 2 in the morning after putting a shift in at work1
Should anyone need to look at said junction on Google Earth it is Carr lane/Heathfield rd in Southport Merseyside. My son was pulling out of Heathfield road right into carr lane the other car came from the right on the blind side of a car that was turning left. Can't do links I'm afraid, not that clever!
Thanks again one and all0 -

In the above link, are you saying that a car coming from the right was turning left onto Heathfield Road, and a car behind that car was overtaking by going into the hatched area to the right?
If so, I don't see how your son can be at fault. A car should never overtake in such circumstances. Not only are they going into a lane intended for people turning right when travelling in the opposite direction, but they're overtaking on approach to a junction and near a bend. Overtaking there is ridiculous if I have understood correctly.
There's only one lane and if the car turning left was blocking your son from seeing the other car, then it would appear that he made the appropriate observations but the other driver's dangerous manoeuvre caused the accident.
Also, I don't see what your son has to lose by seeking half an hour's free advice from a solicitor and asking what his chances are! What will your verse be?
