A dog is NOT a robot. The best behaved dog in the world is not 100% perfectly behaved all day every day. I have been knocked over by a dog - no harm done - but I would not have sued if it had been. I have come close to going over when a small child ran straight into my path and in my attempt not to hurt the child I almost went over, also when a child on a bike suddenly shot in front of me. Again, if I had been hurt I would not have dreamt of trying to sue the parents.

So you know the dog is not a robot. So you let it run about and say oh well these things happen?

The fact they were running has little to do with it I think as a big dog can easily knock over a person who is standing still. For what it is worth, I couldnt work from home either. Why do people make such daft comments when they know nothing of the person's job? As a dog owner, if somebody was badly injured owing to my dog charging into them then i would expect them to claim against my pet insurance. Those that do not have insurance probably should (and this goes for cyclists too who can injure others).

One of my ex's had a couple of lurchers, one a big boy. Anyways he was walking down the back garden (had been away) Goss saw him, came racing up, jumped .... and two days in hospital and concussion. He went flying.

Aside from the issue of compensation for pain and suffering, I always thought that the NHS offered good sick pay packages ?

I have to admit that yes I have been hit by a bouncy lab and it brought tears to my eyes. Couldn't say much though as the dog was being chased by my mutt at the time

They do. 6 months full pay then 6 months half pay.

Andyclockwise just incase you have another look at this thread your partner can claim ESA when she goes on to half pay. It won't replace her income but it may help a little.

Interesting thread. What would happen in this situation if the animal was something like a fox or badger?

No liability, they are wild. For some reason I remember cats causing an car accident are also classed as wild. But dog owners are responsible for accidents caused by their dogs.

So if she works for the NHS and gets 6 months on full pay on sick-where does loss of earnings come into it ?

She already had 5 months off last year, she wont get another 6 months full sick pay I would think. Depending on how the annual leave year runs, if its January to January she might 2 months and then onto half pay.

We have big dogs who have run in to us occasionally and once another person. Had that been serious I would have expected a claim to be made for loss of earnings. As it was it was not serious and the robust adult was knocked over but not injured by a young dog and after the shock that always comes with a fall found it quite humorous. Perhaps they might have found it less so had we tried to evade showing concern and responsibility?

I've also been knocked over by other people's dogs. C'est la vie. If I were injured I would appreciate help, even just getting home and stuff. Just beggaring off showing no concern in a situation of boisterousness rather than antagonism between dogs is IMO a poor show.
