Dog ran into me and I broke my ankle - now what?

    As for the holiday,presumably you have travel insurance so that aspect should be covered.

    Do you have sickness cover on your mortgage?

    Also is there any way that your partner can be accommodated in the work place if the working from home option isn't viable?

    Personally I think you need speak to the owners like rational human beings.

    The one thing I will say is that if something as relatively trivial as a broken ankle is going to cause you this much financial hardship you really do need to be looking at either getting work yourself or somesort of income replacement plan just in case something more serious happens to her

    The dog causes injury. Its owner is negligent but the victim should bear the financial cost fully. There has not even the faintest suggestion on this thread that the dog owner should in any way bear some of the costs. Really, this tells me everything I need to know. This is about people selfishly thinking of themselves (understandable to some extent) with no consideration for others (not understandable). The compensation culture argument has merely been a red herring. I'm out of this discussion, with a new appreciation of the depths to which people will sink to protect themselves.

    sounds like you were running too fast, what would have happened if a small dog had have popped out and you trod on it, injuring or killing it?

    or a small child had appeared and you ran into it, injuring him/ her?

    zero sympathy, tough lesson for you, when out running, if you see a gate or opening, alleyway, road etc, be prepared to slow down and pay attention

    i personally hope you get nothing out of this

    Sometimes an accident is just that- an accident. I think the OP would have a hard case proving the dog owner was negligent not having the dog on his lead if his own dog was also loose .

    I don't think the OP sounds like an ambulance chaser at all. It's a total nightmare to suddenly lose income and the roof over your head be at risk. The other dogs owners should have their dog insured for at least 3rd party, and if they haven't I've little sympathy because they could have got it for £25.
    If I was the other people I would want to be putting things right. When my dog wrote off a car I was so relieved that the guy who owned the car would not be out of pocket (he was a lovely guy whose first concern was for my dog).
    I would be mortified if I thought my animal had caused somebody such financial and physical distress and would be wanting to help put things right as much as I could.
    Some legal advice is definitely called for, so that everything is done properly. Hopefully your own pet insurance could help, or one of those 'first half hour free' legal consultations.
    There's no reason at all why this can't be solved amicably, they would have to be pretty sh*t selfish people not to want to help put things right.
    People on here are acting as if a broken ankle is trivial- hopefully it will heal according to plan, but it may lead to further problems - I hope it doesn't.
    If the 2 dogs had started playing then the case is not clear cut at all, but if the OPs dogs played no part in it then the OP deserves compensation.
    ps about mortgage insurance- mine only kicked in after 6 months off

    Yes,totally correct.
    How dare they be running(you will note they are following the couch to 5K program) too fast.

    What if a small child had been where the OP was as the dog ran out? Zero sympathy and a tough lesson for them?

    I hate the compensation culture too but it does seem harsh that the OP and girlfriend have to suffer such large financial losses. It was an accident but that doesn't mean that compensation may not be due (all car accidents are accidents surely and we don't just say no problem). Hopefully their pet insurance has a public liability section. Difficult - I can see it from both sides and would be mortified if my dog caused such an injury but equally if I were the one injured I would need some sort of compensation as I don't get much sick pay from work and would be screwed.

    esmeralda - you've completely misunderstood my post.

    The OP has said that there are financial implications to this accident....the loss of earnings (and the implied impact of being able to pay the mortgage) and the holiday.

    So do you think its right that the OP gets to claim off the dog owner for the cost of the holiday as well as being able to claim off his travel insurance, effectively having two bites of the cherry ???

    If they income protection insurance,which will pay out in this event, then what is so wrong in claiming on it ? Surely the fact that the OP and his partner won't have the stress of worrying about the mortgage is something to be glad of?

    Do you think that the dog's insurance company won't be asking these questions????

    The pain and distress aspect of it is a totally different thing all together

    As for my last comment then yes I do think that this accident could be a wakeup call for the OP if they haven't got these sort of income insurances especially as the partner is the sole earner and they seem to be in a pickle when she's incapacitated.

(which could just as easily have been caused by falling downstairs, no other person/dog involved)

    Could have, but didn't. Should motorists not bother with third party insurance, because a car could be damaged by a trolley in car park, a tile falling off a roof, a deer running across the road?
