Argos product Not As Described

I had the need for a new vacuum cleaner, specifically with a dusting brush attachment. I found the Vax C86-VC-BP on sale at half price at Argos - and duly purchased it. On opening the box at home I found that the product does not include a dusting brush. This is not 'missing' - this product does not come with that attachment ever.

I emailed Argos (we aim to answer within 48 hours) asking that they please send me the attachment 'as described' online. Argos has not replied as of 96 hours later.

I know I could take it back and get a refund but that would mean I have made two trips (3 hours), paid for petrol and parking, and end up with no product - all because of Argos' mistake.

I would be grateful for any advice on how to handle this?

p.s. the Vax C86-VC-BP is still described online as including a dusting brush (as of July 4).

    If it doesn't have adusting brush - then sadly it doesn't have a dusting brush.

    They may be kind and give you a voucher as a good will gesture but there again they may not.

    Yes there is - OP can go back to Argos and demand a refund. At the same time, request a refund of the travel costs (there and back).

    Sorry I did not make myself clear. I was meaning there was nothing he could do about the cost in returning the item. Not that he couldn't return it which he said he already knew he could do.

    But there is.

    Where the other party is in breach of contract, they are responsible for reasonable costs incurred that are a direct result of their breach.

    OP wouldnt incur those costs if they weren't in breach/the contract had been performed correctly. Ergo, retailer is liable.

    There's a few on here ;);) who spouted hot air when I said in December that I'd be pursuing Very through to court. Sent them their 7 day before action with all my costs etc and not only did I get paid out for both mobiles but also received interest and delivery charges back.
